Which school does the house belong to?

Starting school is a crucial period in a child’s life. The level of knowledge acquired by the student will determine the chances for higher education and a good profession.

Parents of a future first-grader must decide a lot of questions: which school is assigned to a certain address, which school will the child go to according to registration, will this school provide a sufficient level of education? Under what conditions can you enroll in another school that is not geographically located in your home? Which educational institution to choose: school, gymnasium or lyceum? When should I apply for admission so as not to be late and not miss my turn? We will answer these and other questions in this article.

Right to education

All citizens of the Russian Federation have the right to free general education. This right is guaranteed by Article 43 of the Constitution of the Russian Federation. The right to general education is realized by a network of comprehensive public schools, education in which is free and compulsory for all citizens of the country who have reached the age of 6.5-8 years.

The state also guarantees the opportunity to receive free secondary and higher vocational education, albeit on a competitive basis.

In addition to state schools, there is a network of non-state general educational institutions - gymnasiums and lyceums, which have passed state accreditation and received licenses to carry out educational activities. Education in these educational institutions is provided on a fee basis.

Choosing a school, gymnasium or lyceum for a child is the decision of parents or guardians. Territorial affiliation of schools by address

The concepts of permanent and temporary registration when enrolling in school

According to Article 43 of the Constitution of the Russian Federation, all citizens have equal rights to receive education. Article 5 of the Law of the Russian Federation on Education indicates that lack of registration cannot serve as a reason for refusal of enrollment in a general educational institution.

At the same time, paragraph 4 of Article 67 of Federal Law No. 3 states that preferential categories have a priority right to enrollment in schools. According to this law, first of all children who have permanent or temporary registration in the school district are enrolled. Persons with permanent and temporary registration receive equal rights upon enrollment.

This is confirmed by Federal Law No. 273, which directly indicates the right of citizens of the Russian Federation to study in a general educational institution not only at the place of residence (permanent registration, Form 8 of the Federal Migration Service of the Russian Federation), but also at the place of actual residence (temporary registration, Form 3 of the Federal Migration Service of the Russian Federation).

 Therefore, parents of a future first-grader need to prepare documents in advance to confirm the child’s registration in the area of ​​the chosen school.

If parents want to send their child to a school in another municipal district and receive priority entry rights, they can apply for a temporary registration. Such registration will place the child in the priority category for enrollment.

Children under 14 years of age cannot be registered (temporarily or permanently) separately from their parents. Therefore, temporary registration in the desired area is usually completed by one of the parents. The landlord's consent to temporarily register a child is not required. A certificate of temporary registration of a child is issued at the temporary registration address of the parent of the Federal Migration Service of the Russian Federation.

Who has priority to be enrolled in school?

According to Part 1 of Article 55 of the Law “On Education in the Russian Federation,” admission to educational institutions is carried out on the principles of equal rights. Exceptions are provided for beneficiaries, the list of which is fixed in the same law.

At the same time, paragraph 3 of Article 67 of Federal Law No. 273 establishes a territorial criterion, which ensures the priority right to receive citizens living in the area assigned to this institution. And among children with registration, children from families in preferential categories receive priority right to admission.

The full list of categories with the right of priority enrollment is given in Federal Law No. 273 “On Education in the Russian Federation”, as well as in Order of the Ministry of Defense of the Russian Federation No. 32.

If, after enrolling beneficiaries and children with registration, there are still free places in the school, they are filled on a competitive basis with children who are registered in other areas or without registration. But even for free places, beneficiaries without registration or with registration in another area are first of all enrolled.

There is a specific deadline for submitting documents. For most schools in the Russian Federation, this is the period from January 20 to June 30, for children in preferential categories - from December 15 to January 20.

It is better to check the deadlines in advance with the chosen school, since it may differ in different educational institutions.

If the application and documents are not submitted on time, the child will be enrolled only if there are free places, the right of priority enrollment by registration or by preferential category is lost.

Is it possible to apply to two schools at once?

Yes, you can. It should be remembered that the acceptance of applications “by registration” lasts from January 20 to June 30, for children on benefits - from December 15 to January 20, and from July 1, if classes are understaffed, applications are accepted for free places.

To apply to 2 schools, submit your application “by registration” by June 30 in order to retain the right of priority admission, and from July 1, contact another school that interests you. If your child is admitted to an empty place, withdraw the registration application and take the full package of documents to the selected school.

Registration of temporary registration in the area assigned to the selected school transfers the child to the priority category for enrollment and increases the chance of admission.

 At the same time, the right of priority admission to the school at the place of permanent registration is retained. In this case, applications can be submitted from January 20 to June 30 to two schools.

They can refuse admission to the chosen school only if all the places in it are occupied by children admitted “by registration”.

Why may they refuse enrollment?

❌ Inappropriate age. According to the Russian Federation Law “On Education”, you can enter a general education institution after 6.5 years. Therefore, one of the reasons for refusal of enrollment is inappropriate age. At the same time, often the level of preparation of children is quite high and a younger child can be included in the number of first-graders. The school management considers such issues individually.

❌ The documents were submitted at the wrong time. Admission may also be denied if parents missed the deadline for submitting documents and all places at the school are already taken.

❌ Classes are staffed “according to registration”. If documents are submitted on time, and the number of children with the right to priority admission exceeds the number of places, the school management will be forced to refuse someone.
