Passport office staff recommend registering a newborn within 30 days of birth. The Code of Administrative Proceedings (Article 19.15) states that registration must be done within 90 days. In case of violation, a fine is imposed. But it can be challenged.

What the law says

The procedure for registration is established at the legislative level.

Registration of a newborn: deadlines and fines

Parents who neglect to register their child are penalized. The legislation establishes that it will be expressed as financial liability - by imposing a fine.

Depending on the type of violation, the penalties vary. Article 19.15 of the Code of Administrative Offenses applies to violators, which states that parents will face a fine of 2,500 rubles.

Currently, migration service employees have the right to impose a fine on parents for late registration of a child if registration at the parents’ place of residence was not carried out within 1 week after moving or receiving a birth certificate. In this case, the fine is similar to an administrative penalty and ranges from 2 to 3.5 thousand rubles .

The size of the fine depends on the following indicators:

  • type of registration - permanent or temporary;
  • circumstances due to which registration was not carried out;
  • locality;
  • category of violator – legal or natural person.

The fine for lack of registration for a newborn child is the same as for an adult.

There are situations when a fine is not issued. For example, a mother and baby were undergoing long-term treatment. In this case, the fine is not charged by the passport office employees, but only a warning is issued. If the baby’s father was on a business trip, and the mother simply had no one to leave the baby with, then this is not considered a valid reason to cancel the fine.

Article 19.15 of the Code of Administrative Offenses contains a note according to which a fine is not imposed if the newborn is the child of the owner of the apartment, who already has registration in this residential area.

Material punishment is valid only upon receipt of notification of it in writing. You can pay at any Savings Bank cash desk. Payment details are issued by the migration service. Other payment methods are not acceptable.

Is it possible to appeal

If the parents do not agree with the fine issued. Then you can submit an application to the department of the migration service that imposed the punishment. If it is rejected and liability is not removed, it is allowed to appeal to the district court.

Rules
