Persons who have a permanent disability due to age or due to health problems, who have lost their breadwinner, in accordance with the provisions of Federal Law No. 400, receive the right to receive insurance pension payments. The concept of “loss of a breadwinner” in this situation means the death or disappearance of a person who was supporting a disabled dependent.

The fact of his death or disappearance must be confirmed by official documents - an extract from the registry office about the death of a citizen, or a court order declaring him missing. The accrued pension benefit can be received either personally by the person to whom it is accrued or by his representative.

If a survivor's insurance pension is assigned to a minor or incompetent person, such official representative is a parent, guardian, adoptive parent, or representative of an orphanage institution. 

Pension payments are made monthly, on certain dates. Legislative regulations provide for several options for receiving payments:

  • Through the post office upon personal appearance of the pensioner or his representative.
  • By transfer to a bank account or plastic card.
  • Home delivery by postman or employee of a specialized service.

The recipient chooses one or another pension delivery option independently, based on personal preferences. He can change the delivery form at any time by submitting a corresponding application to the local pension fund office.

Conditions for assigning an insurance pension for the loss of a breadwinner

Dependents who were in the care of a deceased citizen have the right to receive such a pension payment. Among the main conditions for assigning an insurance pension for the loss of a breadwinner are:

  • The deceased has an insurance period of any duration.

To assign a pension to persons entitled to it, it is necessary to contact the territorial body of the state pension fund. When applying, you must submit the required set of documents:

  • Application for assignment of pension benefits.
  • A general passport, or another ID that replaces it.
  • Documents confirming the death or disappearance of the breadwinner.
  • Certificates confirming the insurance history of the deceased trustee.

Duration of appointment

After submitting the application along with the accompanying documentation, PF employees are required to consider it within ten days. Amount of survivor's insurance pension

The amount of monthly insurance pension payments is calculated by PF employees using a special formula. In each individual case, the size of the survivor's insurance pension will be different.

According to the provisions of the current legislation, the total amount of benefits for the loss of a breadwinner must exceed the subsistence level. To assign a payment, the following documents are required:

  1. Statement;
  2. Personal identification in the form of a passport;
  3. Medical certificate confirming the death of the breadwinner;
  4. Certificate that confirms the presence of family ties;

Registration procedure

Types of pension insurance in the Russian Federation

As part of the implementation of the strategy for the early development of the pension system, the Ministry of Labor and Social Protection developed completely new principles for calculating pensions. The new legal regulation of the pension system does not contain the concept of “labor pension”. It has been replaced by two payments that are independent of each other: insurance and savings.

Based on Federal Law No. 400-FZ “On Insurance Pensions,” there are three types of insurance payments :

  2. by old age;
  3. on disability.

Thus, all disabled members of his family who supported him have the right to an insurance pension in the event of the loss of a breadwinner.

Relatives are recognized as dependents if they were fully supported by the deceased and his assistance was their main source of income.

Such a pension is paid as long as the person is declared incapacitated, in some cases for an indefinite period.

A missing person is considered equal to a deceased breadwinner if his absence is documented.

Old-age insurance payments are assigned when men reach the age of 60, and women - 55.

In addition to age, you must have at least 15 years of work experience (by 2024) and an individual pension coefficient greater than 30 (by 2025).

If these conditions are met, this pension provision is granted until the end of life.

Citizens recognized by federal medical and social examination institutions as disabled people of groups I, II and III have the right to payment of disability

To establish this type of pension, the length of work experience does not matter, and the reason for the onset of this disability does not play a role either. In case of complete absence of insurance experience, a social benefit is assigned.

Disability insurance pension provision is assigned until the day the right to an old-age pension is established.

Who is entitled to a survivor's pension?

Article 10 of the Law “On Insurance Pensions” has the right to payments in the event of the loss of a breadwinner:

  1. Close relatives of the deceased ( children, brothers, sisters, grandchildren ) who have not reached the age of majority, or longer if they are studying in state institutions of secondary specialized and higher professional education (but no later than 23 years);
  2. Parents and spouse of the deceased breadwinner, if they have reached retirement age (men - 60 years old, women - 55 years old), or if they are disabled. The same condition applies to grandparents.
  3. Immediate relatives over the age of 18 who care for other family members under the age of 14, although they themselves may not be dependents.

Payments of this insurance coverage have a number of features :

  • Disabled parents and spouses can apply for a pension at any time.
  • The payment continues upon entering into a new marriage.
  • Children of the deceased before reaching the age of 18 are automatically recognized as dependents. Dependency of children of deceased parents who have not reached the age of majority does not require proof . Exceptions to this list are persons who were involved in any way in the death of the breadwinner, and whose guilt was proven during the trial.
  • Disabled family members who have reached the ages of 55 and 60 years (women and men, respectively) have the right to switch to this type of pension if it is beneficial for them.

It should be noted that adopted children have the right to receive payments on the same basis as their relatives, just like adoptive parents if they have raised children for more than 5 years.

Until what age is a survivor's pension paid?

For minor dependents, insurance payments are made until the age of 18 . However, if these relatives of the deceased breadwinner are studying full-time in government institutions, then the pension is paid throughout their studies, but no later than 23 years . The same condition applies to orphans.

In addition, pension insurance in connection with the death of the breadwinner can be assigned indefinitely , but only if he is disabled.

If a dependent is already receiving an old-age insurance pension, he can switch from it to a survivor's benefit if it is more beneficial.

In this case, he will receive a payment in the event of the death of the breadwinner for the rest of his life.

Where and when should I apply for registration?

To assign an insurance pension related to the death of a breadwinner, you must contact the Pension Fund of Russia (PFR ) at your place of residence or the multifunctional center (MFC ). At the moment, in addition to a citizen’s personal application for a pension:

There are no strict time frames for applying. The application is reviewed within 10 days, and the payment itself is established from the day you apply for it.

It is worth keeping in mind that in some cases the pension is assigned earlier than the day the documents are submitted.

So, if the required list of papers was submitted within 12 months from the date of death of the breadwinner, then the payment is established from the date of death.

If the application was made a year or more later, then the pension provision is established 12 months earlier than the date of application.

How to apply for a survivor's pension

Disabled members of the family of the deceased breadwinner who were dependent on him, regardless of the duration of the breadwinner's insurance period, as well as the cause and time of his death.

Members of the family of a deceased breadwinner are recognized as his dependents if they were fully supported by him or received assistance from him, which was a constant and main source of livelihood for them (at the same time, the dependence of children of deceased parents under the age of 18 does not require proof (with the exception of children recognized as fully capable before the specified age).

The following are recognized as disabled family members of the deceased breadwinner:

  • children, brothers, sisters and grandchildren of the deceased breadwinner who have not reached the age of 18;
  • children, brothers, sisters and grandchildren of the deceased breadwinner, studying full-time in basic educational programs in organizations engaged in educational activities, including foreign organizations located outside the territory of the Russian Federation, until they complete such training, but no longer than until they reach the age of 23;
  • children, brothers, sisters and grandchildren of the deceased breadwinner over this age, if they became disabled before reaching the age of 18;
  • in this case, brothers, sisters and grandchildren of the deceased breadwinner are recognized as disabled family members, provided that they do not have able-bodied parents;
  • parents and spouse of the deceased breadwinner, if they have reached the ages of 65 and 60 years (men and women, respectively) (subject to the transitional provisions provided for in Annex 6 to Law No. 400) or are disabled;
  • grandparents of the deceased breadwinner, if they have reached the age of 65 and 60 years (men and women, respectively) (taking into account the transitional provisions provided for in Annex 6 to Law No. 400) or are disabled, in the absence of persons who are obliged to support them;
  • disabled parents and spouse who were not dependent on the deceased breadwinner, regardless of the time elapsed after his death, if they lose their source of livelihood;
  • one of the parents, spouse, grandfather, grandmother of the deceased breadwinner, as well as a brother, sister or child of the deceased breadwinner who has reached 18 years of age, if they are not working and are at the same time caring for children, brothers, sisters or grandchildren of the deceased breadwinner who have not reached 14 years of age and entitled to an insurance pension in the event of the loss of a breadwinner. In this case, the right to this type of insurance pension arises regardless of the fact of being dependent on the breadwinner.

Adoptive parents have the right to an insurance pension in the event of the loss of a breadwinner on an equal basis with their parents, and adopted children - on an equal basis with their own children.

A stepfather and stepmother have the right to an insurance pension in the event of the loss of a breadwinner on an equal basis with their parents, and a stepson and stepdaughter - on an equal basis with their own children, subject to certain conditions.

Citizens can apply for a pension at any time after the right to it arises.

An application for a pension can be submitted by a citizen to the territorial body of the Pension Fund of Russia of his choice, or to a multifunctional center (hereinafter referred to as the MFC), if an interaction agreement has been concluded between the territorial body of the Pension Fund of the Russian Federation and the multifunctional center for the provision of state and municipal services and the submission of the said application is provided for by the list of state and municipal services provided in the multifunctional center, established by the agreement, or by mail.

The application can be submitted personally by the citizen who is assigned the pension, his representative, or through the employer. A citizen can also submit an application in the form of an electronic document through the “Personal Account of a Citizen” on the official website of the Pension Fund or through the “Unified Portal of State and Municipal Services (Functions).”

If an application for a pension is submitted with all the necessary documents, the obligation to submit which is assigned to the applicant:

  • personally (by a representative, through an employer) the day of applying for a pension is the day the territorial body of the Pension Fund of the Russian Federation receives the application;
  • by mail - the day of applying for a pension is the date indicated on the postmark at the place where the application was sent; 
  • through the MFC – the day of applying for a pension is considered the date the application was received by the MFC;
  • through the “Citizen’s Personal Account” on the official website of the Pension Fund and the Unified Portal of state and municipal services (functions) and submission to the territorial body of the Pension Fund of all necessary documents, the obligation to submit which is assigned to the applicant, no later than three months from the date of receipt corresponding clarification, the day of applying for a pension is considered to be the date of filing the application in the form of an electronic document.

Russians who have left Russia for permanent residence and do not have a place of residence and place of stay in Russia confirmed by registration, submit an application directly to the Pension Fund of Russia (Moscow, Shabolovka St., 4).

  • an identification document (for example, a passport of a citizen of the Russian Federation, a residence permit of a foreign citizen (stateless person), birth certificate (for a child under 14 years of age), etc.);
  • documents on the death of the breadwinner (death certificate);
  • documents confirming family relations with the deceased breadwinner (birth certificate, marriage certificate, adoption certificate);
  • documents confirming periods of work, other activities, other (non-insurance) periods of the deceased breadwinner. Documents must be correctly executed (contain the number, date of issue, last name, first name, patronymic (if any) of the citizen to whom the document is issued, the day, month and year of his birth, place of work, period of work, profession (position), grounds for issuing them ( orders, personal accounts, etc.), signature of an official (authorized) person, certified by the seal of the organization). Documents issued by the employer upon dismissal from work may be accepted as confirmation of the insurance period even if they do not contain the basis for their issuance;
  • other documents necessary to confirm additional circumstances.

If not all required documents are attached to the application, you will be given an explanation of what documents should be submitted additionally. If you then submit the missing documents no later than three months later, the day you applied for a pension will be considered the day the application was received.

The documents, the obligation to submit which is assigned to the applicant, are listed in the Administrative Regulations for the provision by the Pension Fund of the Russian Federation of state services for the establishment of insurance pensions, funded pensions and state pensions, approved by Resolution of the Board of the Pension Fund of January 23, 2019 No. 16p.

  • When sending an application in the form of an electronic document using a “personal account” on the “Unified Portal of State and Municipal Services (Functions)” and the Pension Fund of Russia website, identification documents, age, and citizenship of the citizen are not required.
  • If a citizen agrees to grant a pension based on the individual (personalized) registration information available to the territorial body of the Pension Fund of the Russian Federation, the submission of additional documents is not required.

To assign an insurance pension in the event of the loss of a breadwinner, the following conditions must be met:

  • the deceased breadwinner has an insurance period (at least one day);
    the death of the breadwinner, or recognition of him as missing in court;
  • being dependent on a deceased breadwinner, except for the cases provided for in Article 10 of Law No. 400-FZ.
  1. An application for an insurance pension in the event of the loss of a breadwinner is considered by the territorial body of the Pension Fund of the Russian Federation no later than 10 working days from the date the territorial body of the Pension Fund of the Russian Federation receives the application with all the necessary documents.
  2. If a citizen is given clarification on the submission of additional documents for the assignment of a pension, the application is considered within 10 working days from the date of submission of the last missing document necessary for its assignment, if such a document is submitted no later than three months from the date of receipt of the corresponding clarification territorial body of the Pension Fund of Russia.
  3. If a citizen, simultaneously with the application, has not submitted, on his own initiative, the necessary documents at the disposal of other state bodies, local government bodies or organizations subordinate to state bodies or local government bodies, the territorial body of the Pension Fund considers the application for a pension within 10 days from the date of receipt from the specified bodies of documents requested by the territorial body of the Pension Fund.
  4. An insurance pension in the event of the loss of a breadwinner is assigned from the date of death of the breadwinner, if the application for the specified pension followed no later than 12 months from the date of his death, and if this period is exceeded, 12 months earlier than the day when the application for the specified pension followed.

The pension is paid monthly. The pensioner has the right to choose, at his own discretion, the organization that will deliver the pension, as well as the method of receiving it (at home, at the cash desk of the delivery organization or to his own bank account).

In addition, a trusted person can receive a pension for a pensioner.

Payment of a pension by power of attorney, the validity of which exceeds one year, is made during the entire validity period of the power of attorney, provided that the pensioner annually confirms the fact of registration at the place of receipt of the pension.
