Can an individual entrepreneur receive maternity benefits?

Social insurance for entrepreneurs on a voluntary basis

According to the law “On compulsory social insurance in case of temporary disability and in connection with maternity”, an individual entrepreneur is exempt from the obligation to participate in the state insurance system. In addition to individual entrepreneurs, this rule also applies to:

  • lawyers and notaries whose activities are registered in accordance with the legislation of the Russian Federation;
  • doctors and other specialists in private practice;
  • citizens involved in farming;
  • members of tribal communities of indigenous northern peoples.

The procedure for entry of individual entrepreneurs into the state social insurance system

Child benefits in connection with maternity for individual entrepreneurs

In 2017, an individual entrepreneur can receive government assistance only if he has paid all insurance premiums for 2016. This norm is valid for each subsequent year.

The exact amount of benefits received is calculated taking into account the duration of the vacation and the minimum wage valid for a particular region. For a normal pregnancy without complications, the amount of state assistance as of 2017 ranges from 35 thousand to 40 thousand rubles.

Benefits for registering with a antenatal clinic in the early stages of pregnancy

This payment is in addition to the basic benefit amount. It is paid to a woman if she registers no later than the 12th week of pregnancy. In 2016, this amount was 581.73 rubles. On February 1, 2017, the benefit was increased through indexation. Thus, now it is 613.14 rubles.

The Government believes that such an amount, albeit a small one, is an incentive for a woman to register with the consultation as early as possible and properly monitor the course of her pregnancy.

According to Russian legislation, monthly child care benefits for individual entrepreneurs are calculated differently than for employed citizens. This norm is prescribed in Government Decree No. 375 of June 15, 2007.

In the case of employed citizens, the amount of the benefit is calculated taking into account the average salary. For individual entrepreneurs, this indicator, as mentioned above, is replaced by the minimum wage. Thus, the amount of monthly payments for individual entrepreneurs is 40% of the minimum wage.

The minimum wage from July 1, 2017 is 7,800 rubles. 40% of this amount – 3120 rubles. The minimum benefit amount prescribed by law is as follows:

  • for the first child – 3065.69 rubles;
  • for the second child and subsequent children – 6131.37 rubles.

Thus, in the event of the birth of the first child, an individual entrepreneur is entitled to a benefit in the amount of 3,120 rubles. However, after the birth of the second child and subsequent children, the entrepreneur receives 6131 rubles 37 kopecks, since this is the minimum prescribed in the regulations of the Russian Federation. A lesser benefit may not be paid to any recipient.

Do not forget also that the minimum wage increases periodically. In 2017, it increased by 300 rubles compared to the previous year. Due to such changes, the amount of benefits that individual entrepreneurs are entitled to increases, albeit slightly.

How can an individual entrepreneur receive a monthly child benefit?

Types of child benefits according to law

Child benefits for individual entrepreneurs

Individual entrepreneurs (IP) can also be provided with benefits for the birth of children, as well as for persons employed under an employment contract. However, their payment can only be made if contributions are made to the Social Insurance Fund (SIF), which are optional for individual entrepreneurs.

How to voluntarily enter into legal relations under compulsory social insurance

Entry into legal relations occurs at the initiative of the entrepreneur by submitting an application to the territorial body of the Social Insurance Fund. The annual amount of premiums payable is determined by the cost of the insurance year .

How to calculate it?

It is defined as the product of the minimum wage (minimum wage) established for the current year (in 2016 - 6,402 rubles ), the insurance rate of 2.9% and 12 (the number of months in the year).

Voluntary contributions of individual entrepreneurs to the Social Insurance Fund

  • DV = minimum wage x T x 12, where

If the amount is not paid in full, or the payment is not paid, the individual entrepreneur will be deregistered. In this case, no fines or penalties will be charged, and all amounts paid during the year to the entrepreneur will be returned back.

In this case, the individual entrepreneur will not be able to count on benefits.

This year, only those entrepreneurs who paid their insurance premiums in full last year can receive insurance benefits.

Maternity benefit for individual entrepreneurs

To receive benefits, an entrepreneur will need to contact the Social Insurance Fund and provide an application and sick leave. The application can be written in free form. The amount of payment in this case will depend on the number of days of vacation under the BiR.

For a normal pregnancy and childbirth, this leave is provided for 140 days, for a multiple pregnancy - 194 days, and in the case of a complicated birth, another 16 days will be added to the sick leave . The amount of payment will be calculated based on the minimum wage established in the current period.

To do this, the minimum wage is divided by the number of days in a month and multiplied by the number of days of vacation according to the BiR.

Payment upon early registration

In order to receive payment for registration in the early stages of pregnancy, a woman must contact an antenatal clinic no later than 12 weeks of pregnancy.

One-time benefit for the birth of a child individual entrepreneur

If an entrepreneur has paid voluntary insurance contributions, he will be able to receive the payment due at the birth of a child. Its size is 16,759.09 rubles. If more than one child was born, the payment will be multiplied by the number of children. In those regions of the Russian Federation where a regional coefficient has been established, the payment will be increased by this coefficient.

The benefit can be received immediately after the birth of the baby and receipt of a certificate for it. Not only the mother, but also the father can apply for such a payment. In our case, the father is an entrepreneur.

You will also need to contact the Social Insurance Fund, submit an application and the necessary documents:

  • Applicant's passport;
  • Child's birth certificate;
  • Birth certificate;
  • A certificate confirming that the second parent did not receive such benefits.

The benefit will be accrued within 10 days from the moment the individual entrepreneur submits the application, and its payment will occur before the 26th day of the month following the month of application (article ⇒ Maternity leave for the grandmother or father of the child).

Benefit up to 1.5 years for individual entrepreneurs

The childcare benefit for a child under 1.5 years old will be paid in the amount of 40% of the minimum wage, but for the first child it should not be less than 3,142.33 rubles, and for the second and subsequent children - 6,284.65 rubles. To apply for benefits, you will need to contact the Social Insurance Fund - if the entrepreneur paid voluntary contributions, or to social security - if he did not draw up a voluntary insurance agreement.

  • Payment to women who registered before 12 weeks of pregnancy;

The amount of the entrepreneur's annual contribution is calculated using the formula:

In 2019, the tariff rate is 2.9%, and the minimum wage is 11,280 rubles. The tariff rate will remain at the same level in 2020; its indexation is not expected, while the minimum wage is indexed every year.

If you miss paying a fee or do not pay it in full, you are automatically deregistered. In this case, no fines or penalties will be charged, just all the transferred amounts of contributions for this year will be returned back, and you will not be able to count on the payment of benefits.

Only those entrepreneurs who paid the insurance premium for the past year can receive benefits in connection with an insured event that occurred this year.

For pregnancy and childbirth

To receive maternity benefits, you need to contact the territorial office of the Social Insurance Fund and submit the following documents:

  • an application for payment of benefits written in any form;
  • sick leave.

The size of the payment will depend on the number of calendar days that are provided for carrying the pregnancy to term and caring for the child.

Singleton pregnancy 70 days for pre-pregnancy and 70 days for caring for a newborn.
Multiple pregnancy 84 days for pre-pregnancy and 110 days for caring for the baby.
Complicated or premature birth 16 days are added to sick leave.
