Although denial of employment in the absence of a passport (in the presence of a temporary certificate) is not considered a valid reason, employers often do not want to hire an employee. - Difficulties with financial transactions. If there is a need to withdraw money or close an account, the owner of the VUL may face trouble. Temporary identity card of a citizen of the Russian Federation
In accordance with the Regulations on the passport of a citizen of the Russian Federation, approved by Decree of the Government of the Russian Federation of July 8, 1997 No. 828, a passport of a citizen of the Russian Federation is the main document identifying the citizen of the Russian Federation on the territory of the Russian Federation; all citizens of the Russian Federation who have reached the age of 14 are required to have it. summer age and living in Russia.

What is needed to obtain a temporary ID card
A temporary identity card for a citizen of the Russian Federation can be obtained from the migration department by applying for the issuance (replacement) of a passport.
There is no need to write any additional statements. When submitting documents for a new passport, the applicant may verbally express a desire to issue a temporary identity card.
- You only need to submit one extra photo, which will be pasted into the ID.
- Moreover, there are no exceptions to this rule.
- In accordance with the current Regulations, a temporary certificate is issued subject to the following conditions:
- after establishing the identity of the citizen;
- confirmation of his citizenship of the Russian Federation.
- When a citizen applies for the loss or theft of a passport, this document is issued only after confirmation of the fact of issue of the lost or stolen passport.

Temporary ID Form
The form of a temporary identity card is provided for by the Administrative Regulations of the Ministry of Internal Affairs of the Russian Federation for the provision of public services for the issuance and replacement of passports of citizens of the Russian Federation, identifying the identity of a citizen of the Russian Federation on the territory of the Russian Federation, approved by Order of the Ministry of Internal Affairs of Russia dated November 13, 2017 No. 851.
The temporary identity card is made on punched card paper and has a size of 176 x 125 millimeters. The certificates are subject to numbering according to the register of temporary identity cards of a citizen of the Russian Federation. The number assigned to the ID consists of 12 digits.
The first six digits indicate the code of the migration department of the territorial body of the Ministry of Internal Affairs of the Russian Federation (for example: 615008), the next two digits of the number indicate the current year of issue (for example: 18). The last four digits are the serial number of the certificate according to the register of temporary identity cards of a citizen of the Russian Federation (for example: 0138).
The certificate indicates the date and grounds for its issuance, the name of the migration department that issued this document, as well as its validity period.
The certificate is certified by the signature of the head of the unit and the seal.
Information about the citizen contained in the temporary identity card
The temporary identity card contains the following information about the citizen of the Russian Federation in whose name it is issued:
- last name (if available);
- name (if available);
- patronymic (if available);
- Date of Birth;
- Place of Birth;
- address of residence (place of stay).
A photograph of the owner is pasted into the certificate, which is sealed with the seal of the unit.
In paragraph 38.8 of the above Regulations of the Ministry of Internal Affairs of the Russian Federation it is written: “If it is necessary to issue a temporary identity card for a citizen of the Russian Federation in form N 2P, an additional photograph is provided.”
Validity period of the temporary certificate
- A temporary identity card of a citizen of the Russian Federation is a document of limited validity.
- It is issued to a citizen of the Russian Federation for the period of registration of a new passport.
- Depending on the period during which the passport will be issued, the validity period of the temporary certificate is indicated.
- If the passport is issued within 10 days, a temporary identity card will be issued for 10 days, if 30 days, then a temporary identity card will also be issued for 30 days.

- Upon receipt of the passport, a temporary identity card is surrendered.
Restrictions on the use of a temporary ID card
- The certificate we are considering, although it is an identity document of a citizen of the Russian Federation, however, unlike a passport of a citizen of the Russian Federation, it has a number of restrictions on use.
- And this applies not only to limiting its validity period.
- In practice, the scope of application of a temporary identity card is somewhat limited.

It is not possible to travel outside the Russian Federation to those countries to which travel is permitted with an internal Russian passport.

A temporary certificate cannot be used to issue a foreign passport.

Registration is not carried out either at the place of residence or at the place of stay.
- In some cases, refusal to accept a temporary certificate as an identification document may be considered unlawful.
- For example: when purchasing airline and railway tickets, when conducting banking transactions, when applying for a job.
- In these cases, a citizen of the Russian Federation can appeal against unlawful actions of officials by contacting senior management or the relevant prosecutor's office.

Issuance of a temporary certificate without an application for a passport
- In accordance with paragraph 141 of the Regulations, in order to promptly issue a temporary identity card in the event of loss or theft of a passport issued by another migration department and the absence of documents confirming the identity of a citizen, without opening a case of loss (theft) of a passport, based on an application submitted citizen in any form, a check is carried out to establish his identity and confirm the issuance of the lost passport.
- A temporary identity card without opening a case of loss (theft) of a passport is issued to a citizen for travel to his place of residence for a period of up to 10 days.
- At the same time, in the “In connection with” column of the temporary identity card it is indicated: “For travel to the place of residence, without opening a case about the loss (stolen) of the passport.”
- That is, a citizen who has lost his passport while in another city has the opportunity to contact the migration department in this city with an application for the issuance of a temporary identity card of a citizen of the Russian Federation.
- Despite the fact that in this case the validity of this document is limited to the above-mentioned period, its execution allows the owner to return to his place of residence as soon as possible and receive a passport to replace the lost one.

In order for a citizen to enter into legal relations with state, municipal and commercial organizations, to exercise his rights and fulfill his duties, his identity is required to be confirmed and certified.
Typically, a citizen’s passport serves as a document confirming personal data. However, in some cases when it is not available, a temporary certificate can be used. Let's figure out what this document is, when and how it can be obtained - and what it can be used for.
○ Temporary identity card of a citizen of the Russian Federation
In essence, a temporary certificate is a substitute for a passport.
It is issued and used in cases where a real passport is not available: lost, damaged, in the process of being replaced due to the age of the citizen, etc.
In order to ensure that while a new document is being drawn up, the citizen is not left without documentary proof of his identity, a temporary ID is used.
You can get it at any passport office where passports are issued. A citizen, having submitted the necessary documents to obtain a regular civil passport, has the right to request that a temporary certificate be issued to him during the preparation. Unlike a passport, it is issued immediately on the spot within a period of time, usually not exceeding 10 minutes.
The validity period of such a certificate is 2 months. However, if necessary, the authorized employee of the government body who issued this document may further extend its period for another period of time.

○ Obtaining an ID
Let us now consider the order in which the certificate is prepared and issued.
✔ Who issues
Until recently, the preparation and issuance of certificates was entrusted to the Federal Migration Service of the Russian Federation.
However, since April 2016, these functions were again returned to employees of the Ministry of Internal Affairs, and specifically to the Main Directorate for Migration, the department dealing specifically with migration issues.
However, the previous regulations continue to apply, including the Administrative Regulations for the issuance and replacement of a passport of a citizen of the Russian Federation, approved by Order of the FMS dated November 30, 2012 No. 391.
You can receive this public service in the following ways:
- By personally contacting the territorial division of the Ministry of Internal Affairs.
- Use the “State Services” portal (provided that there is registration on this portal - therefore this option is available only to those who have already completed the procedure and registered in advance).
- Contact MFCs that provide state and municipal services - in those localities where they are organized.
- Contact officials of social service organizations - for people who are in these organizations.
We must remember that when applying electronically, you can only avoid standing in line and unnecessary checks, but not a visit to the Ministry of Internal Affairs: one way or another, the document can only be issued in person.

✔ What documents are required
In order to obtain a temporary certificate, a citizen must submit all the documents required to replace a passport. Here is a list of them according to the Administrative Regulations and the Regulations on the Passport of a Citizen of the Russian Federation (approved by Decree of the Government of the Russian Federation No. 828 of 07/08/1997) for those cases when the citizen did not previously have a passport:
- Application in the form established by the Ministry of Internal Affairs of the Russian Federation.
- Birth certificate.
- International passport - for persons living primarily outside of Russia and who do not have a civil passport.
- Photos in the amount of 2 pieces. Size – 35 by 45 mm.
In cases where the certificate is issued at the time of passport replacement, the set of documents will be slightly different:
- Statement.
- Old passport. If it is lost, then documents confirming the loss (for example, a police certificate, etc.).
- If the replacement occurs due to a change in first name, surname, date of birth or gender - documents confirming that a replacement is required.
- Photos of the same size and in the same quantity.

✔ Timing and cost
As already mentioned, a temporary certificate is issued within 10 minutes. Data from the old passport is entered into it, a photograph is pasted in - and therefore this document can well be used in almost all cases as a full-fledged replacement of the passport.
The law does not provide for additional fees for issuing a certificate. However, since it can only be obtained if a new passport is issued, the citizen will have to pay a fee. As of August 2017, the fee for this public service is, according to Art. 333.33 Tax Code of the Russian Federation:
- 300 rubles – when issuing a passport at 14 years of age or a planned replacement at 20 or 45 years of age.
- 1500 – when issuing a new document to replace a damaged or lost one.
But the certificate itself does not pay for it. It is issued as a temporary replacement for a passport, is not an independent document - and therefore does not require payment of a state fee.

✔ What if your application is refused?
Unfortunately, it happens that the Ministry of Internal Affairs employees responsible for accepting documents and issuing passports refuse to issue temporary certificates. Usually, they refer to the fact that additional data verification is required, there are no forms, or some other grounds of varying degrees of far-fetchedness.
It is important to remember: the legislation does not provide grounds on which a citizen can be refused to issue a certificate. Therefore, it makes sense for a person who is faced with a refusal to immediately go to an appointment with the immediate supervisor of such employees and file a complaint about their actions. As a rule, this is enough.

○ Features of use
Like any other document, a temporary certificate has certain limits for use. Let's see how and in what cases it can be used.
✔ Air travel
A passport is required to purchase airline tickets. Can a temporary certificate replace it?
This problem was acute in the early 00s, when some airlines recognized such a document, while others did not sell tickets using it and even refused to allow passengers on board with already purchased tickets - and, accordingly, did not refund their cost.
As a result, the situation was resolved directly by the Ministry of Transport of the Russian Federation, which in 2004 directly explained that a temporary certificate confirms identity and therefore can be considered as a full-fledged replacement for a passport.
However, this only applies to domestic flights. Problems may arise with flights abroad, which are discussed below.

✔ Travel abroad
This is what a temporary certificate is absolutely not suitable for - traveling abroad. Even in those countries where an internal Russian passport is sufficient and a visa is not required, a Russian citizen will not be able to pass border control with such a certificate.
However, in situations where only the internal passport has been lost, but the foreign one has been preserved, you can travel – then only with a foreign passport, and not with an identity card.

A situation often arises when a citizen turns to a bank to open or close an account or receive money, but they refuse to service him because his passport is not yet ready. Are the actions of bank employees legal?
We must remember: in all cases when a bank requires a passport, in fact, by law, they must require an identity document. And therefore, a temporary certificate in form No. 2P fully meets these criteria.
In case of a dispute, a citizen can refer to the letter of the Federal Tax Service of the Russian Federation dated 01.04.
2002 No. SA-6-05/394@, which concerned the taxpayer’s identity card - and which directly provides for the identification as one of the supporting documents (on a par with, say, a soldier’s military ID or an officer’s ID).

✔ Labor relations
Another problem is employment during the period when the passport is not yet ready and the certificate is valid. Can an employer refuse to hire someone based on this document?
Here you need to be guided by Art. 65 Labor Code of the Russian Federation. It stipulates that when concluding an employment contract, a citizen is obliged to present a passport or other document with which to verify his identity. A temporary certificate fully meets the criteria provided for in this article - and therefore refusal to issue it in this case will be completely illegal.
In the event that a refusal does occur, the citizen affected by the employer’s actions has the right to appeal to the regulatory and supervisory authorities (labor inspectorate, prosecutor’s office, etc.), or directly to the court.

✔ Marriage registration
Is it possible to get married using a temporary certificate? Will the marriage be registered at the registry office?
Unfortunately, serious problems are possible here. The fact is that, according to Art. 26 of the RF IC, a passport or other identification document is used during registration. But at the same time, according to clause 5 of the Passport Regulations, a note is made in the passport that the marriage is registered. You can’t do this with an ID; there’s simply no corresponding column there.
In general, the issue remains controversial, and a clear solution to the problem is not indicated in the legislation. But still, during the period until a new passport is issued, it is better to refrain from getting married.

✔ Is it possible to register using an ID?
Citizens often have problems registering at their place of residence or stay. Is it possible to register using a temporary ID instead of a passport?
Here, as with marriage registration, you need to take into account that there is no opportunity to make a note about registration on the certificate - the 2P form does not provide space for such entries.
In addition, the Administrative Regulations for the provision of public services for registration (approved by Order of the Federal Migration Service No. 288 of September 11, 2012) in its paragraph 15 provide for a list of identification documents for registration.
There is no temporary certificate listed there. Therefore, it is impossible to formally register using such a document.

✔ You need to obtain a passport
You need to apply for a foreign passport - but you only have a temporary certificate in your hands. What to do in this case?
Unfortunately, the answer here is simple: you need to wait for your passport to be issued. You cannot issue a passport using a temporary certificate.
The administrative regulations concerning passports valid outside the Russian Federation (approved by order of the Federal Migration Service No. 320 of October 15, 2012) provide for an exhaustive list of documents - and in clause 28.1.
1 only passports, domestic or foreign, are considered as identification documents. There is no certificate provided there.
