Benefits for the loss of a breadwinner: their types, to whom they are available and where they are issued

The death of a breadwinner is the reason for the accrual of subsidies, concessions, and various types of assistance. Upon death, the relatives of the deceased (those who depended on him) submit the relevant documents to the social security authorities.

Material support is an important, but not the only part of assistance. Children and other applicants are entitled to receive:

  • discount on utilities, special offers for housing and communal services;
  • preferential travel method;
  • food from the dairy kitchen for young children;
  • availability of budget places in higher educational institutions - an important condition is passing entrance exams;
  • discounts on medical care, special programs, free medicines - a special prescription is issued.

The death of a breadwinner is not the only reason for obtaining financial or other assistance. If parents go missing and are absent for more than a year, financial assistance is awarded to their children.

In order to receive financial assistance, you will have to confirm the fact that the family finds itself in deteriorated conditions. An appeal to social service authorities is the reason for considering the case.

Benefits 2019

State assistance to families without a breadwinner is regulated by Federal Law 10 of 2013. The basic payment is called insurance assistance. The applicants are family members of the deceased or missing.

The fact of dependency is decisive - the family must be dependent on the earnings of the deceased person. The exception is cases when family members themselves are to blame for the death of the breadwinner.

Until 2019, the norms for awarding aid remained the same. Dependents have the right to receive not only financial assistance, but also use a simplified system of education and medical care. Children left without the help of one or two parents are entitled to a free school or a simplified process for entering a university or college.

Benefits in 2019 are provided to orphans, adopted children, growing up in single-parent families, people with disabilities, and elderly people who have lost their legal capacity. An unprotected group of citizens has the right to receive benefits, long-term and short-term privileges.

Who is it intended for?

More often, benefits are granted to minor Russian citizens. Benefits are awarded to a wife if her standard of living has declined sharply because her husband was the sole breadwinner.

Relatives of the deceased receive dependent status. They must have the status of disabled people. It is often necessary to prove that the deceased provided for relatives, acting as a kind of guardian.

Minor children under 18 years of age fall under the category of unprotected after the death of the breadwinner. If at the time of the death of the breadwinner they are studying at a university, the age threshold increases to 23 years. College students are subject to a similar rule.

A relative raising a child under 14 years of age has the right to receive benefits. Legally, he is also a dependent due to the predicament: a woman and a man of any age.

The spouse is considered the first priority for receiving benefits, especially with disability status, after reaching retirement age. Any status is confirmed by relevant certificates. The last group of citizens applying for state assistance are disabled minors. They must be relatives of the deceased breadwinner.

How to apply

Benefits in Russia are not provided automatically. Any social status must be confirmed. Registration of assistance for the loss of a breadwinner occurs according to the standard scheme.

The petition is submitted by the dependent or fiduciary. The applicant is guardians, parents, if the vulnerable person is a schoolchild or an incapacitated person.

To submit an application, a package of documents is collected: a certain evidence base. It contains every identity, certificate, document proving relationship, financial dependence on the breadwinner.

What documents need to be provided

Social assistance is aimed at improving the quality of life of people left without support. Submission of documents and applications occurs immediately after the fact of death has been established or after a year has passed when the breadwinner has disappeared. Family and close relatives have the right to receive regular payments.

To obtain financial state aid for an apartment, house, or medical services, a package of documents is collected:

  • a statement written in your own hand;
  • identity card – passport of a Russian citizen;
  • birth certificate, child or student passport;
  • for certain cases - a certificate from the Ministry of Internal Affairs;
  • death certificate of a caregiver, parent, guardian, close relative;
  • documents proving relationship with a deceased or missing person.

Additionally, a copy of the adoption or guardianship documents is submitted. Editing the family composition will allow you to determine what payment or other financial assistance is needed for family members.

An important document is the work book of the deceased. It is used to calculate financial aid. Additionally, a copy of the certificate of work experience and an extract from the Pension Fund are attached.

The standard package of documents includes: documents of a dependent, proving the fact of study or stay with a certain status. Extracts from the university, completion of training in the department of secondary and higher education.

If the breadwinner did not die, but disappeared, you will need a certificate confirming the status of a missing person. The disability of relatives is confirmed by medical certificates.

Where to apply for payment

Insurance pensions are calculated by the Pension Fund. The initial application takes place at the Foundation branch at the place of registration.

A petition to the social protection authorities is necessary to obtain another type of assistance - financial assistance, the accrual of benefits.

Upon consideration of the case and verification of the submitted documents, a single decision is made. After a positive response, financial assistance is credited to the personal account of the dependent or his representative. After 14 years of age, a child has the right to receive payments independently: through a banking institution or mail.

What subsidies are available for children?

Financial support is the same for all vulnerable citizens. Children also receive payments that help improve their standard of living.

Minors have the right to redistribute payments to pay for education. Admission to university is simplified if the child has received a special status - he suffered due to the loss of a breadwinner.

Additionally, children who have lost a relative qualify for free travel. The benefits apply only to public transport. They eat for free in the school canteen and receive a discount on utility bills.

For housing and communal services

The communal apartment directly depends on the region of residence of the relatives of the deceased or missing person. Single-parent families qualify for up to 50% discount on utility bills. The discount varies across Russian regions, but it is no less than 30% of the total amount.

The regional discount changes frequently: it is influenced by the regional budget, various social programs, and tariff changes. To obtain detailed information, you must contact the social protection authorities of the region where the family lives.

The size of the discount also depends on the type of employment of the deceased, his average earnings, and what social programs were used during his lifetime.

Children receiving a pension

After the death of one of the parents, children are left without full guardianship. They belong to a group of vulnerable citizens: they are entitled to free school meals and other social and school programs.

Getting food benefits is difficult. It is used more often by low-income and large families. The likelihood of receiving free school meals depends on the region of residence of the family. Children without a breadwinner are entitled to a social card, free travel, and other regional benefits.

Rights of those who have lost one of their parents

Children who have lost one or two parents claim various benefits. If the father or mother provided for the family, after their death the children receive standard financial assistance. Until the age of 14, it is credited to the account of the guardian, the second parent.

The exception is when the working parent was ill for a long period or committed suicide. Social protection authorities make a negative decision.

An important factor in calculating financial assistance is the type of employment of the second parent. Dependency does not exclude the possibility that a living parent or guardian provides the family with everything necessary. If he is unable to financially support his family, the relevant documents are submitted to the social protection authorities.

At the same time, the second parent is obliged to demonstrate a willingness to bear full responsibility for children and sick relatives, even with partial assistance from the state.

What is required when entering a university?

Orphans, low-income children, children with many children claim to receive privileges upon admission. They do not pass a general selection, take separate exams, and are examined according to a low system.

By law, studying and the opportunity to obtain higher education is the key to a decent standard of living for a child who has lost his parents.

The main condition for preferential admission is that the chosen university is state-owned. All Russian universities are available to applicants. Another mandatory condition: the form of training must be full-time.

If at the time of admission there are no budget places for a number of reasons, the benefit cannot be used. A similar principle applies to admission in absentia.

When entering college

Vulnerable groups go to college for free. Study groups are formed gradually: priority is given to the enrollment of dependent children from low-income families and large families.

Orphans who have lost two breadwinners at once also have the right to apply for free to obtain incomplete higher education.

Regional support programs

Regional programs provide significant financial assistance. They are completely dependent on the local budget. The level of funding significantly affects the size and frequency of financial assistance.

State and general programs come as an addition. Financial assistance alone does not exclude additional programs.

The basis of regional programs are discounts and benefits for certain services. In many regions there is a system of free travel, food, partial and full payment for medical services.

Latest changes in legislation

State support, as part of social policy, is subject to constant modification. The amount of assistance increases every year, and new sources of assistance appear for families dependent on benefits.

Since 2018, the average amount of financial assistance is no less than 5,000 rubles - for orphans who have lost one parent. If the child is left an orphan, the average monthly payment is above 10,000 rubles.

When submitting an application to social protection authorities, many related factors are taken into account - they affect the final amount of financial assistance. Only the general age and dependent status requirements remain constant. Disabled relatives and pensioners left without a breadwinner apply for lifelong assistance.

In the near future, changes will be made to the methods of receiving financial assistance. According to experts, social assistance will be monetized and transferred to a certain monetary equivalent. Innovations will allow us to find an individual approach to each case of loss of a breadwinner.

The loss of a breadwinner is a loss for the family. After the death of a working family member, children, wife, parents live in difficulties.

To maintain the previous standard of living, social programs for calculating material assistance, concessions, and various regional programs are being introduced: minors and people with disabilities or loss of legal capacity receive financial and state assistance.

What are the survivor benefits?

I receive a survivor's pension and know what additional benefits I can qualify for. I’ll tell you what these benefits include and how to apply for them. If you also have the right to a survivor's pension, but you have not applied for it yet, I have already told you how to do this.

Anastasia Berezina

received survivor benefits

Everyone who receives a survivor's pension is entitled to benefits. But there are benefits that are relevant only for certain categories, for example, schoolchildren, students or those who own real estate.

Benefits for the loss of a breadwinner are enshrined in federal and regional regulations:

Depending on how old you are and what you do, you are entitled to different benefits. For example, students from families where a parent has died may receive a free lunch in addition to breakfast.

If a child has already graduated from high school and is 18 years old, he can still qualify for financial assistance at a college or university. Finally, there are several general benefits - regardless of age.

For example, free travel on public transport. I'll tell you about each in more detail.

Where to go. Applications for free meals for the next school year must be submitted in May. If a parent dies during the school year, breakfast and lunch must be provided beginning the following month. Typically, documents are collected at the school and, if necessary, sent to the social welfare department.

Documents for registration. To receive benefits at school, you will need to collect the following documents:

  1. An application addressed to the school director with a request to provide free meals, indicating the reason for the benefit and a list of documents that are attached to the application.

    Sample application to school

  2. A copy of the child's birth certificate.
  3. A copy of a certificate from the Pension Fund of Russia confirming receipt of a pension.

Read also: Preparation of documents for traveling abroad: with one of the parents, without parents, different surnames

In addition to these documents, others may be requested, for example, information about the financial status of the family, Form 9 and SNILS.

Certificate from the Pension Fund about receiving a pension

Where to go. Documents are submitted directly to the university. They are considered individually; the timing of payment of assistance also depends on the university.

Documents for registration . Documents usually ask for an application, a copy of the passport and a copy of the death certificate, but the list may be different depending on the university. It happens that documents are accepted only within six months after the death of a parent or only in the first quarter. It is better to clarify these details with the university.

Documents for registration. The minimum documents they usually ask for are:

  1. Passport. If the card is issued for a child under 14 years of age - the child’s birth certificate.
  2. Certificate from the Pension Fund regarding the assignment of a pension.
  3. Photo size 3 × 4 cm.

They will issue you a temporary paper travel pass for a month, and after 30 days you can come to the MFC again to pick up your completed card. In Moscow, this card also gives discounts in bookstores, grocery stores and other stores. Always check to see if there are any benefits for you.

Take yours from the state! We tell you how to receive deductions, benefits and benefits in our newsletter twice a week

There are discounts in many museums and theaters. For example, at the Pushkin Museum you can usually count on a 50% discount. To receive such benefits, take with you a certificate from the Pension Fund about the assignment of a pension.

The set of documents is larger than for Muscovites:

  1. Application with consent to the processing of personal data from the child or his representative.
  2. Birth certificate - for children under 14 years of age.
  3. Passport - for children over 14 years old.
  4. Original certificate from the place of study.
  5. Original certificate from the Pension Fund of the Russian Federation confirming the assignment of a pension.
  6. If the documents are submitted by a representative, then his passport or other identification document is needed.
  7. Certificate of registration in St. Petersburg.
  8. Photo format 3 × 4 cm.
  9. SNILS and its copy.

Where to go. To ensure that you are not charged tax, submit your application in a convenient way:

Subsidy. Do not forget about the subsidy for housing and communal services, if it is provided for by regional law.

Although this benefit is not directly related to survivor benefits, it is often provided to recipients of such a pension - due to the low family income.

For example, if in Moscow you spend more than 10% of your family income on utility bills every month, you are entitled to a compensation payment. In other regions this percentage may be higher or lower.

Where to go. Submit documents in person to the MFC. In Moscow, you can also apply for a subsidy via the Internet; documents can be downloaded on the mayor’s website.

  1. Passports of all family members, for children - birth certificates.
  2. A certificate of income in a certain form or about the absence of income for the last 6 months for all family members over 16 years of age.
  3. If you do not pay for utilities using a single payment document, attach the latest receipt for housing and communal services and a document confirming the absence of debt.
  4. Details of the card where you want to receive the subsidy.

On the website of the mayor of Moscow there is information about certain “special cases” when paying. In particular, it mentions people whose family members have died. I called the single information center of the MFC, where the operators of the city hall website directed me.

They said that they were not aware of any special cases for receiving housing and communal services subsidies; there were no special conditions for beneficiaries. So, recipients of survivors’ pensions will receive a subsidy on the same basis as other citizens.

The subsidy will be awarded for six months, then you will need to resubmit the application and package of documents.

Benefits for the loss of a breadwinner - what is a child entitled to besides a pension in 2020?

Often the only hope for a bright material future after the loss of a breadwinner for a family is the state, which provides certain benefits. In the Russian Federation there are several legislative provisions that imply the provision of payments and social support to children who have lost their breadwinner.

In this article we will talk about which categories of citizens are entitled to federal assistance in connection with the loss of a breadwinner, and what benefits in this regard exist today.

Who can count on survivor benefits?

State and social assistance to children left without the protection of one of the breadwinners is assigned in accordance with Federal Law No. 178, adopted in 1999. Benefits after the loss of a breadwinner can be applied for by every disabled family member who was dependent on the deceased. The exceptions are persons who contributed to the death of the breadwinner.

Benefits after the loss of a breadwinner can be applied for by every disabled family member who is dependent on the deceased. The exceptions are persons who contributed to the death of the breadwinner.

Survivor benefits are intended for:

  • family members unable to work who were previously supported by the deceased;
  • minor children of the family (blood connection does not matter - this provision also applies to a warded or adopted child);
  • persons under 23 years of age undergoing training as part of a budget educational program;
  • brothers, sisters, children or grandchildren of the deceased who have a medical certificate of disability;
  • relatives of the deceased who have reached retirement age and have a disability document;
  • parents or spouse of the deceased who were declared legally incompetent.

What benefits are there?

In addition to receiving a social pension, a family that has lost its breadwinner may be provided with social services in other forms.

This rule is enshrined in the Federal Law “On State Social Assistance” dated July 17. 1999 No. 178-FZ. This service is intended to support the livelihoods of citizens.

In certain regions of Russia, other types of assistance may be established.

As of 2019, in most constituent entities of the Russian Federation, children who have lost their breadwinner are provided with the following benefits:

  • free meals in the dairy kitchen (children under 2 years old);
  • lunches in school canteens at state expense;
  • provision of free textbooks;
  • receiving free medicines (children under 3 years old);
  • free admission to museums, cinemas, exhibitions and theaters;
  • financial compensation in the amount of 1,500 rubles for persons under 23 years of age.

For each child in a family that has lost its breadwinner, you can also receive a tax deduction. The maximum tax reduction is possible in the amount of 1,400 rubles. After the third child, this deduction increases to 3,000 rubles. For disabled children who have lost their breadwinner, the tax deduction will be up to 12,000 rubles.

In addition, if a breadwinner loses, his family can apply for a social benefit for burial. To obtain it, you must contact the Social Insurance Fund or social protection authorities. The benefit is paid if the application is made no later than 6 months from the date of death. The basic benefit amount is 4,000 rubles, this amount is indexed annually.

Certain categories of citizens who have lost financial security after the death of a family member are entitled to social assistance. Among the needy categories, pensioners and disabled people are often identified. These categories of citizens are provided with:

  • free or discounted travel on public transport;
  • the ability to purchase and deliver products;
  • the possibility of cleaning the premises by representatives of social services or volunteers.

Special attention is paid to orphans who have lost both parents. In addition to pensions and financial compensation, they are entitled to the following benefits:

  • issuance of own housing;
  • free regular issuance of vouchers to summer health camps;
  • assistance with job search and career guidance;
  • retraining free of charge;
  • free secondary vocational and higher education

Which authorities provide it?

To receive such forms of state financial support, you need to contact the territorial body of the Pension Fund of the Russian Federation at the applicant’s place of residence, the Department of Social Protection of the Population, or the Social Insurance Fund - these are the organizations that administer social assistance and recalculate the amount of subsidy payments. It is possible to submit an application by sending an electronic document via the Internet, however, to provide a complete package of documents, the applicant’s personal presence will still be required.

How to get a?

It is possible to apply for benefits in the event of the loss of the sole breadwinner by contacting the Pension Fund of Russia with an application. In this case, it is necessary to collect a basic package of documents that will confirm family ties with the deceased.

Where to contact?

To receive benefits, you must register your status by contacting authorized government agencies. There are several bodies dealing with these issues:

  • Pension Fund - you can contact here regarding the payment of cash benefits and compensation;
  • Social Insurance Fund - issues of issuing funeral benefits, transferring the funded part of the deceased’s pension and other insurance payments are resolved here;
  • Department of Social Protection of the Population - on issues of in-kind assistance, registration of social benefits (free travel and food, distribution of medicines).

To receive preferential benefits through the Pension Fund, you must follow a certain procedure.

Step 1. Completing an application for benefits.

Step 2. Collection and provision of documents, the list of which will be separate for each type of assistance.

Step 3. Waiting for the application to be reviewed by a special commission that submits the application to social security. Based on it, a decision is made, which is the basis for subsequent actions by the social protection authorities.

The algorithm of actions for applying to the district Department of Social Protection of the Population is no different from processing documents through the Pension Fund. However, it is in social security that citizens often encounter officials who do not want to provide them with the required benefits, therefore, when asking for clarification, it is recommended to immediately name the specific type of benefit and find out about its availability in the region.

To receive some types of social benefits and payments, you can also contact the Social Insurance Fund. The process of completing documents in this case will not differ from the steps described for receiving compensation for the loss of a breadwinner from the Pension Fund.

Another way to apply for survivor benefits is a single social card as a universal document. At the moment, after the introduction of such a document in Moscow, many regions are introducing a social card for persons with preferential conditions. This electronic document contains information about the owners and the benefits to which they are entitled.

People registered with social security can receive it. To apply for an ESC, you must complete the following steps:

  • collect a certain package of documents, which will include a pension certificate, passport or birth certificate, 4 photographs;
  • Contact the MFC at your place of residence with a package of documents.

It should be remembered that the social card in many regions has not yet become a single document for confirming rights to benefits. Often, paper confirmation is required along with it, and the only benefit that can be easily obtained is discounted travel on public transport.

What documents are needed?

Registration of benefits is possible only in case of personal application to the relevant authorities. If the payment concerns minor children, then the applicant is the second parent, guardian or authorized representative.

The list of documents for registration of benefits includes the following papers:

  • death certificate of the breadwinner;
  • income certificate;
  • details of the bank card to which funds should be transferred;
  • work record book of the deceased and his family members;
  • SNILS.

Additionally, if necessary, documents about the disability of a family member, a military ID, and papers proving the fact of guardianship or adoption are provided.

More information about survivor benefits and how to apply for them can be found here:

Thus, the types of possible survivor benefits that family members can receive depend on the specific situation, as well as on the place of residence of the family.

One way or another, all categories of applicants specified in the current legislation can count on such payments.

To receive payments, family members must personally contact government authorities with a certain package of documents.

Benefits for the loss of a breadwinner - what additional benefits is a child entitled to?

Child benefits

34.1 thousand

The loss of a breadwinner, in addition to the feeling of loss, also brings financial problems to the family. The state partially compensates for the material deprivation experienced by the family - it pays a pension. In addition to this, those in need of help can also enjoy other benefits.

Benefits for the loss of a breadwinner are provided to persons who were dependent on the deceased:

  • native children;
  • adopted children, whose rights are not limited in any way, but are equal to the rights of half-blooded children;
  • stepchildren from a previous marriage raised in the family.

The age of eligibility for benefits is limited to adulthood or 23 years if the child is receiving education. Those who become disabled before adulthood retain benefits throughout their lives.

The following categories of dependents are distinguished: disabled people who have lost one parent, and orphans. They use help, regardless of the presence of relatives who may support them.

After the death of a parent, it is not necessary to prove that the children were dependent on him, unless they are adults or became fully capable before their majority.

The main benefit is a social or labor survivor's pension, the payment of which is guaranteed at the federal level. In addition, Law No. 178, Art.

12 guarantees social services in cash and in kind in the form of subsidies, social benefits, and other payments. Social assistance is aimed at maintaining the living standards of citizens.

Individual subjects of the Federation establish types of assistance, the amount and procedure for payment. They are slightly different in each region.

Various types of assistance may be provided at the same time if they collectively do not exceed the established maximum amount of payments.

At the time of receiving a pension, a monthly cash payment is established; it is paid by social protection authorities. The amounts differ in the regions, but the total pension with additional payment should not be less than the subsistence level for the region.

The benefit is paid monthly until the age of 16, and for students until the age of 18 if the income is less than the subsistence level.

In addition to monthly payments, the student receives an annual compensation for the purchase of clothing, which is issued by the educational authorities.

The child is also provided with other benefits and assistance in kind:

  • dairy products and mixtures for children up to two years of age, and for a chronic disease included in the list - up to 15;
  • free prescription medications up to age three;
  • travel on public transport while receiving a pension;
  • up to 7 years of age can visit zoos, museums, exhibitions, and parks under municipal jurisdiction free of charge;
  • from 7 to 18 years old (up to 23 for students) - the opportunity to visit the zoo and other cultural institutions for free at discounted prices;
  • for students of secondary schools - two meals a day and textbooks;
  • free meals for students receiving vocational education.

Regional authorities can expand the list and introduce additional types of assistance.

To receive benefits, you must apply for benefits. There are two authorities for processing documents.

To receive a pension, apply to the Pension Fund branch, for other cash payments, benefits and in-kind assistance - to the district department of social protection of the population.

It is in social security that people often encounter the reluctance of officials to issue the required benefits. People who have rights to them often do not know whether they are valid at all. When contacting the department, name the benefit and ask if it is available.

A person in loco parentis, or a father/mother who is involved in maintaining and raising a child after the death of the breadwinner, seeks help. You must write an application and submit documents; their list is separate for each type of assistance. The application is considered by a special commission, which submits a proposal to social security.

Based on it, a decision is made, which serves as the basis for further actions by the social protection authorities. Cash payments can be issued in the form of social benefits or subsidies. Social benefits are issued free of charge from the budget in the form of a certain amount.

The subsidy is targeted and fully or partially covers the payment for social services provided by family members.

Natural assistance includes food, medicine, clothing and shoes. The procedure is approved by the executive branch. For example, free medicines can only be obtained with doctor's prescriptions. They prescribe medications from a list approved by the regional authorities.

Following Moscow, many regions are introducing social cards for people with benefits. This is an electronic document containing information about the owner and the benefits to which he is entitled. Persons registered with social security departments can also receive it, i.e. it is also intended for children who have lost their breadwinner. To receive it, contact the MFC with the following documents:

  • pensioner's ID;
  • passport or birth certificate;
  • photo.

With the card you can buy products at a discount in special stores, you can use it as a travel document on public transport. The card is also a document that provides benefits for free medicines.

Plus, it performs almost all the functions inherent in bank cards: replenishment and movement of funds, settlements, deposits. The social card has not yet become the only document to confirm the right to benefits. Often, paper confirmation is required along with it.

The only benefit that is easy to get is free travel.

Dependents' pensions may not reach the minimum subsistence level in force in the region where the recipient lives. The state has provided additional payments to children receiving a survivor's pension.

Social supplement for children before they reach adulthood is assigned immediately after the right to such a pension arises. An application from the person entitled to the additional payment is not required. The ratio of the subsistence level (LS) and total income is taken into consideration.

Depending on the result of the ratio, an additional payment is assigned:

  • federal from the Pension Fund, if material support (MS) is below the subsistence level in Russia and the region;
  • regional, established by social protection if the Moscow region is lower than the cost of living in the region, and that is higher than the federal one.

The MO amount includes, in addition to the pension, all monthly additional payments. The system of payments and assistance for children who have lost their breadwinner is quite complex. Everything about pensions is very clear.

Obtaining benefits and compensation is difficult because only some of them are actually available: free travel, textbooks, meals for schoolchildren. With others the situation is more difficult.

If educational institutions constantly provide benefits for students, parents or guardians have to achieve others. The main thing is to know that they are required, then you can talk to officials with confidence.

Benefits for the loss of a breadwinner in Moscow

The loss of a breadwinner leaves a family without means of subsistence. At the same time, the relatives of the deceased do not always have the opportunity to provide for themselves. Therefore, the state provides benefits for the loss of a breadwinner.

Relatives can count on them if their actions did not lead to the death of a loved one. The last circumstance must be proven in court.

The application is made to the local branch of the pension fund. You can visit the structure in person, act through the Multifunctional Center for Public Services or a representative. The legal right to receive benefits is:

  • natural or foster children, adopted children and under 18 years of age;
  • incapacitated family members;
  • relatives studying at domestic and foreign universities who have not reached 23 years of age;
  • pensioners who were dependent on the deceased;
  • disabled people who received the group before reaching adulthood;
  • elderly parents who are not under the guardianship of the deceased, but who have lost their income after his death;
  • citizens caring for relatives of the deceased who have not reached the age of 14 years.

Application is possible at any time after the death of the breadwinner. The statute of limitations is not important in this case.

The benefit can be social and labor. In the first case, payments come from the budget. Their size is agreed upon for each individual group of dependents. Such payments are paid if the deceased did not have a permanent place of work.

Labor benefits for those receiving a survivor's pension are determined based on the place of work of the deceased and other circumstances:

  • service of the deceased in a military structure or in a government position - the amount of compensation will depend on the position, causes of death, and membership in a certain category of workers.
  • the area of registration of the deceased citizen - for example, for the Far North a high compensation coefficient is assigned;
  • conditions of death - if death occurred as a result of a man-made disaster or radiation, then the social pension increases by 2.5 times.

The amount of benefits is constantly increasing in accordance with the level of inflation and the cost of living. You can find out about the current payment amounts on the official website of the Pension Fund of the Russian Federation.

All citizens entitled to benefits also have the right to lower housing and communal services payments. Reduce tax deductions by the percentage specified in the legislation. Benefits apply to all family members of the deceased.

Children left without parental care receive special attention from the state. Special social programs have been developed for them. Survivor benefits for children include:

  • dispensing prescription drugs free of charge for up to 3 years.
  • visiting the circus, theater, and other cultural events.
  • provision of school textbooks and lunches.
  • free travel on city public transport.
  • obtaining municipal housing. The condition is the absence of an apartment or house inherited from parents.
  • assistance in employment.
  • free education without passing a general competition.

Children under 18 years of age can apply for benefits. Extension to 23 years is possible upon receipt of higher education. The grace period does not include master's degree studies. Funds for a child under 14 years of age are received by a guardian.

Few people can defend their right to reduce payments or eliminate them. Often citizens do not know their rights or rely on canceled documents. As a result, they do not use the benefits that are rightfully due to them. Officials, in turn, are in no hurry to help those in need and provide them with an appropriate status.

Benefits and allowances for the loss of a survivor in 2019

According to Article 10 of Federal Law No. 400 of December 28, 2013 “On Insurance Pensions”, “the right to an insurance pension in the event of the loss of a breadwinner has the disabled members of the family of the deceased breadwinner who were dependent on him (with the exception of persons who have committed a criminal act that entailed constitutes the death of the breadwinner and established in court)".

This law guarantees that individuals who have lost someone at whose expense they existed will receive material support from the state. Such payments should partially compensate for the income of the deceased.

Who is entitled to survivor benefits and the amount of benefits in 2019

Benefits for the loss of a breadwinner in 2019 guarantee minors the necessary social protection: not only monthly payments, but also appropriate treatment (in educational institutions, in public transport, when receiving medical care).

Other individuals also have the right to such state support:

  • relatives of the deceased person who lived off his income;
  • adopted children. And if the breadwinner was the adopted child, the adoptive parents are required to submit an official document that would confirm that they have been caring for the deceased for the last 5 years;
  • close relatives of retirement age: men over 65 years old, and women over 60 years old, that is, parents and spouses;
  • relatives of the deceased who were officially assigned the status of disabled people. But only if they have no one else to help them;
  • individuals under 23 years of age who are studying full-time at state universities or studying outside the country.

It should also be remembered that the amount of survivor benefits in 2019 depends on where the minor lives.

However, despite this factor, the amount of funds to which the child is entitled must be 50% of the total income of the deceased father or mother.

Moreover, if a family has not one child, but two or more, the state is obliged to pay a pension that compensates 100% of the income of the lost parent.

Another important fact is whether the deceased person had at least one day of work experience.

Minors and full-time students will receive a social pension if their parent worked without registration.

The amount of such a survivor's benefit in 2019 each month is 4,959 rubles if the child lost his father or mother, and 9,919 rubles if he was left an orphan.

What survivor benefits are available to relatives of a deceased person in 2019?

What benefits for the loss of a breadwinner in 2019 are granted to close relatives of a deceased person, and what can they even count on? Since the income of this person was the only means of providing for his family members, the state guarantees that:

  1. Firstly, people of retirement age are entitled to receive a bonus, the amount of which is 15 thousand rubles.
  2. Secondly, relatives who have lost their breadwinner can use public transport for free.
  3. Thirdly, pharmacies will provide medications to family members of the deceased on preferential terms. Moreover, these persons can count on free medical care.
  4. Fourthly, the amount of payment for utilities should be only 50% of the total amount.

What benefits for a child in case of loss of a breadwinner exist in 2019?

In 2019, benefits for a child in case of loss of a breadwinner include several mandatory items:

  1. Children under 2 years old can eat for free in the dairy kitchen.
  2. Schoolchildren have the right to eat twice in the canteen at state expense. In addition, they are entitled to free textbooks.
  3. Applicants can count on benefits upon admission and during their studies at universities.
  4. Children under 3 years of age should receive medications free of charge.
  5. Visits to exhibitions, cinemas and theaters must be paid for by the state.

It should also be noted that persons who have not yet turned 23 years old are entitled to financial compensation - 1,500 rubles - if they have lost their mother or father.

Tax and other benefits for the loss of a breadwinner in 2019, indexation of benefits

Tax and other benefits for the loss of a breadwinner in 2019 will apply only to those individuals who have submitted the necessary package of documents to the regional or municipal branch of the Pension Fund. Relatives of the deceased must visit this institution in person, and instead of minors, their relatives or a second parent can come.

To receive support for certain individuals from the state, you should collect documents such as:

  • a certificate confirming the fact of the loss of a breadwinner;
  • pensioner's ID;
  • marriage certificate of the deceased;
  • documents that confirm the presence of minor children;
  • work record book of the person who was the breadwinner;
  • adoption certificate;
  • bank accounts required for the transfer of monthly government payments.

Let's consider what benefits for the loss of a breadwinner exist in 2019, if the Pension Fund nevertheless decided to provide them.

Firstly, either a social pension will be paid - to children and persons under 23 years of age, or a labor pension, which will apply to all dependent family members.

Secondly, relatives and children of the deceased have the right to benefits such as free or discounted use of public transport, medical and utility services. Payments and benefits come into effect the following month after submitting all necessary documents.

It should be remembered that the survivor's benefit in 2019, as before, is paid only until the child begins to earn a living on his own. Even if he is not yet 18 years old and has already gotten a job, he will not receive government payments.

If the wife of the deceased needs this social protection, but she plans to soon enter into a new marriage, she must complete all the documents to receive benefits until she applies for marriage.

Since the pension system has recently been reformed, it is necessary to pay attention to the fact that the indexation of the survivor benefit in 2019 was 5.8%.

How much is the survivor's benefit in 2019: the amount of benefits

State payments in connection with the loss of a breadwinner are also made in cases where this person was a person in service of this nature:

  • The deceased was a soldier or sergeant and was undergoing military service.
  • The breadwinner was engaged in space research and was a tester.

In addition, social protection is guaranteed to family members of those individuals who died in a man-made or radiation disaster. Radiation sickness acquired during the liquidation of these accidents is also a reason for paying a pension.

People in uniform constantly risk their lives to protect the country. Many people are interested in the question of how much the survivor benefit is in 2019 if a military man died while performing his military duty.

In this case, each member of his family should receive 9,920 rubles. If a serviceman died while not performing his duties - for example, due to illness - the amount of the benefit paid is 7,440 rubles.

It should also be noted that, despite the rule established in the law that does not allow two pensions to be paid at the same time, there are certain exceptions.

Thus, according to the benefits for the loss of a breadwinner in 2019, the spouse of a deceased military man who was in military service can receive this pension along with other payments.

A woman loses this right if she remarries.

Benefits for the loss of a survivor other than pensions

The loss of the only breadwinner in the family, in addition to the feeling of irreparable loss, inevitably brings with it financial problems.

To help those previously dependent on the deceased maintain their level of well-being, the state provides targeted assistance.

Let's take a closer look at what kind of survivor's pension, benefits and other preferences the listed categories of citizens are entitled to.

How to take advantage of the benefits provided to citizens who have lost their breadwinner

Persons who have lost their breadwinner are provided with social protection at the state level in the form of pensions and various benefits.

It states that persons who have lost a family member who provided their financial existence have the right to count on state support. Federal Law No. 178 guarantees the provision of subsidies in cash and in kind.

The following categories of citizens are entitled to take advantage of benefits:

Regional programs

In addition to the benefits established by federal legislation, there are also local preferences assigned by regional authorities.

In some regions of the federation, it is also possible to receive preferential housing for families in need of improved living conditions. The exact list of regional benefits varies, and you can find out about it at your local Pension Fund office or social security authorities.

Types of state support

The main measure of social support for people who have lost their breadwinner is the appointment of pension payments. Their nature depends on whether the deceased had insurance coverage.

If yes, then compensation to his family members is provided in the form of an insurance pension, but if he did not, then in the form of a social pension.

The amount of the insurance pension depends on the number of pension points accumulated during the work activity of the deceased citizen.

The size of the fixed social pension is established by government decree, and it is uniform throughout the Russian Federation. In a situation where the deceased served in government agencies, his family members receive additional financial compensation from the state.

The amount of the pension benefit is also influenced by the cause of death of the breadwinner, as well as the social status of the recipient. For example, if after the death of a parent the child remains an orphan, payments increase by 2.5 times.

If he lives in the northern regions, then this amount is also multiplied by the local coefficient.

Social privileges

Persons who have lost their sole breadwinner may be provided with additional free social assistance. This applies to citizens who are unable to care for themselves - disabled people and elderly people. They may be assigned a visiting nurse, provided with services for cleaning their living space, purchasing food, assistance in caring for the garden, etc.

Orphan child

Children who become orphans after the death of their breadwinner have the right to receive additional benefits. This list includes:

  • When he reaches the age of majority, he is provided with personal living space on the basis of social rent, if the deceased parent did not have his own home.
  • Absolutely free medical care.
  • Providing assistance with career guidance and job placement.
  • Education on a budget basis in a secondary specialized or higher educational institution.

Tax and other benefits

A number of tax preferences apply to citizens who have lost the only breadwinner in their family. Please note that they are not provided automatically, and for this you will need to contact the territorial tax authorities. A survivor pensioner, whose benefits are officially assigned by the Pension Fund of Russia, is exempt from a number of taxes.

Recipients of insurance payments are officially treated as pensioners and have the right to enjoy the privileges they are entitled to. This applies to the abolition of transport tax, tax levies on one of the property owned, etc.

This list, by decision of regional authorities, may include other local taxes, information about which can be obtained from the Federal Tax Service.

Pension indexation

The prescribed survivor benefits are not a strictly fixed amount. Like other pension payments, they are subject to annual indexation, the amount of which usually corresponds to the level of inflation expected in the coming year. So, in 2020 the indexation of payments for non-working pensioners was 7%.
