I constantly read your magazine. There is one question that haunts me.
I am a healthy working man, 26 years old, with a salary of 26 thousand rubles without personal income tax. I have a wife and a minor child. Parents are also present, a complete family. I have been working officially since I was 18 years old, so I pay taxes. We live in a one-room apartment, half of which belongs to me and half to my mother. My wife does not work officially - she is a freelancer.
Will I be able to submit documents to be recognized as a low-income family in order to raise the budget? If yes, how to do it?
Thanks in advance, Dmitry
I’ll tell you how a family can obtain low-income status and what it can receive from the state.
If there are two adults and a child in a family, you need to add up the living wages that are established for each of them. The amount received will be the threshold below which low-income families are located. This value is the cost of living for your family.
You write that your official salary is a little more than 26 thousand rubles after deducting personal income tax. It turns out that before deductions it is approximately 30 thousand rubles.
But bureaucracy was not invented to make everything so simple.
The procedure for recording family income to recognize it as low-income is determined by a special law. The basic rules are:
- The calculation is carried out for the last three calendar months. They are counted from the date of application to the social security authority. The entire family income for three months is taken into account. Then this amount will be divided by three - this is the average family income. It will be divided by the number of family members - this is the average per capita income.
- Income is recorded before taxes and fees are deducted.
- The income of each family member is counted. Not only labor ones. There is a special list of types of income that are taken into account when calculating the average per capita family expenditure. Check if you are getting anything from this list. The social security authority will count not only wages, but also payments under civil law contracts into the total family income. Also taken into account are: scholarships, unemployment benefits, monthly child benefits, income from rental property, payment under civil contracts, income from shares, interest on bank deposits, etc.
I do not advise you to deceive the state. If it turns out that the family’s income was actually higher than you stated, the state will demand all the excess paid back.
For example, there was such a case in judicial practice. The woman was assigned a state social benefit. She indicated only one place of employment in her income information.
The social protection authority learned that she additionally works as a social worker in a government agency. This means that she provided false information about her income.
The social security agency demanded the overpayment back. I had to return 255,227 rubles. The court agreed with this.
To take into account family income, the state must find out about it. For this purpose, the social security authority is given the right to check income information. He can send requests to the tax office, pension fund and Rosreestr, and can check living conditions.
Thus, in St. Petersburg, the court considered the case of a family who applied for social assistance.
The social security agency conducted an inspection and found that the family’s standard of living did not correspond to the income information provided. The family owns a three-room apartment worth more than 7 million rubles.
There are two cars. Previously, social assistance was already paid, but the level of official income did not increase. They did not give me a new social benefit.
You write that your wife has income from freelancing. If she conducts it officially, you need to take this income into account when contacting the social security authorities.
The family must have reasons why the family income is below the subsistence level. For example:
- child under the age of one and a half years;
- one of the family members is disabled;
- several minor children;
- official unemployed status of one of the adults;
- temporary disability of one of the adults, etc.
This list is not directly stated anywhere and cannot be stated. The social security authority assesses how valid the reason why the family finds itself in a difficult financial situation is. His objectivity will be checked by the court. If there are no reasons for low income, social assistance will not be given.
One-time payments. The poor can be provided with financial assistance. In the Vologda region it varies from 300 rubles to 10 thousand rubles. Financial assistance is a one-time payment.
For example, in the Tver region, the size of the social contract payment depends on how many children there are in the family. If there are no children, they will give no more than 40 thousand rubles, if there are no more than two children - 100 thousand rubles, and if there are more than three - 150 thousand rubles.
Payments can be measured in tens of thousands, but all expenses must be coordinated with the state and reported on. The contract may stipulate that you need to undergo training, actively look for work, undergo treatment for alcoholism, or buy agricultural equipment. This is a prerequisite for receiving money.
Social benefits are regular cash payments. Most likely, when talking about how to raise the family budget, you mean benefits. I will give a few examples so that you can imagine the amounts we are talking about.
In the Moscow region, the poor are compensated monthly for an amount that is not enough to reach the subsistence level. The amount of social assistance per family member is from 300 rubles to a thousand per month. They will give no more than 6 thousand rubles per year for each family member.
- In the Pskov region, cash payments to low-income families amount to a thousand rubles if the average per capita family income is below the minimum wage, and 500 rubles if it is higher.
- In the Sverdlovsk region, social benefits for the poor are paid at the rate of 387 rubles per person per month.
- In St. Petersburg, a general rule has been established: social benefits for a low-income family cannot be higher than the difference between the family's subsistence level and its income.
The purpose of paying benefits is to bring the family income to the subsistence level. Unfortunately, the budget cannot be increased significantly with this.
To receive social assistance, you need to contact the social protection authority at the place of permanent or temporary registration. What kind of body this is is determined by the legislation of the subject of the Russian Federation in which you live.
Social assistance to the poor is a government service, so it can be obtained on the government services portal or at the MFC. This simplifies the task. At the MFC, employees will tell you where to address the application.
On the public services portal, successively open the sections “Services”, “Pension, benefits and benefits”:
Next, select the “Help to the Poor” section. You need to scroll down the page:
Next, they will tell you what services are provided to the poor in your region:
There you can also find out how to get the service and what documents you need to collect. Copies can be sent through the government services portal, but be prepared to take the originals to the social security agency in person. Most likely, you will be required to:
- documents confirming the identity of family members;
- a certificate of family composition from the passport office;
- income certificates 2-NDFL;
- work books.
This list differs from subject to subject, as do the amounts of benefits.
Social assistance for the poor is support for those who find it difficult to earn a living. Among them, the state must choose those who have it harder than others and help them. These are the disabled, the seriously ill, the unemployed, single-parent and large families. The state provides them with a living wage. Everyone else provides it for themselves.
If you still want to obtain the status of a low-income family, here is your action plan:
- Calculate your family's average income. Add up payments from employers and customers, interest on deposits and income from rental property.
- Calculate the cost of living for your family in the region where you live. Compare what happened.
- Assess whether there are circumstances due to which you cannot receive more income. For example, if you need to care for a small child.
- Write an application for social assistance to the social security authority at your place of residence. Attach income documents. If you don't bring everything, they will tell you what is missing.
- Result: you will receive some extra money.
If you are not eligible for social assistance, do not be discouraged. So things aren't so bad for you.
If the situation is really difficult, and social security workers are biased, go to court. You can get help from free legal consultations, for example, at law schools. Citizens whose income is below the subsistence level have the right to free legal assistance.

How to obtain the status of a low-income family and what benefits and allowances are provided for low-income families in 2019?
Russia offers comprehensive support for families in need. But to obtain the right to financial assistance from the state, a family must confirm its status as low-income and in need of additional assistance.

Who can receive the status of a low-income family and what advantages does it provide?
According to Russian legislation, a family can be recognized as low-income if the average income of all living members of its family, including children, is less than the subsistence level.
Obtaining the status of a low-income or low-income family gives citizens the right to receive targeted government assistance for persons with low incomes.
The main legal act that regulates the procedure for calculating and paying state assistance for low-income people is No. 178-FZ “On State Social Assistance.” This document contains basic provisions regarding state guarantees for the poor. The list of possible applicants for support is specified in Art. 7 Federal Law.
Federal Law-44 “On the procedure for recording income and calculating the average per capita income of a family and the income of a citizen living alone for recognizing them as low-income and providing them with state social assistance” indicates the rules for calculating average per capita income.
The income accounting algorithm is contained in the Decree of the Government of the Russian Federation No. 512 “On the list of types of income taken into account when calculating the average per capita family income... for the provision of state social assistance to them.”
Details of the calculation of average per capita income and regulations for the provision of public services in the form of targeted support for low-income families are contained in regional legislation.
For example, in St. Petersburg, such a document is the Law of St. Petersburg No. 728-132 “Social Code of St. Petersburg”.
Obtaining low-income status by a family provides it with a wide range of various government benefits and guarantees:
- A variety of cash payments , including child benefits, one-time payments, payments in favor of pregnant and nursing mothers, and an additional scholarship for students.
- Receiving assistance in kind: discounted medications, free or discounted tickets, clothing sets and food for children.
- Registration of benefits and subsidies for utility bills: if monthly expenses on housing and communal services exceed 22% of the monthly family budget (in some regions a different value is set for the maximum share of expenses on housing and communal services).
- Improving living conditions as a priority.
- Separate benefits for individual entrepreneurs in the process of registering their business.
- Admission of children to universities without competition.
- Benefits when paying for kindergarten: in the amount of 20% of the monthly fee for the first child, 50% for the second and 70% for the third.
- Free assistance from lawyers in litigation and disputes.
What is needed to obtain low-income family status?
In order to understand whether a family has the right to count on receiving low-income status, it is necessary to have information about the cost of living per family member established in the region.
Calculating the average per capita income involves going through the following steps.
Step 1. Initially, all family income is summed up. This includes income in the form of:
- salaries;
- interest on bank deposits;
- pension payments;
- alimony;
- scholarships;
- fees;
- royalties;
- benefits;
- income from the rental of property;
- compensation due to loss of ability to work, loss of a breadwinner;
- other payments and subsidies received by family members.
Thus, all monthly revenues to the general family budget are included in the calculations, regardless of whether they are related to the work activities of family members.
When determining the amount of income, income for the three months preceding the application for help is taken into account. In this case, the income of all family members who live together in the same living space is included in the calculations.
For example, if her pensioner mother lives with a single mother, then the amount of her pension will also be taken into account in income.
Thus, when calculating the average per capita income, the concept of “family member” includes not only children and parents, but also other relatives living with them . These include, in particular, grandparents, adopted children and their adoptive parents, stepdaughters and stepsons, stepfathers and stepmothers and other persons.
Confirmation of the fact of cohabitation will be a certificate of family composition from the passport office. It not only lists the names of all persons living in the same apartment, but also the degree of their relationship with the recipient of the certificate.
“Family members” do not include only persons who are officially recognized as missing and who are in prison.
Step 2 . All cash receipts into the family budget for three months are summed up and divided by the number of family members.
Step 3 . The resulting value is compared with the regional cost of living.
The cost of living per family member depends on the individual characteristics of the region. In 2018, the national subsistence minimum per family member was set at 10,701 rubles.
For comparison, in Moscow the cost of living is 16,160 rubles. In St. Petersburg it is 10,449 rubles, in the Republic of Crimea and Sevastopol - 9,994 rubles, in Vladivostok - 12,456 rubles, in Samara - 9,964 rubles, in Yekaterinburg - 9,973 rubles, in Rostov-on-Don - 9,420 rubles ., in Arkhangelsk - 12011 rubles, in Ulan-Ude - 9875 rubles, in Voronezh - 8581 rubles.
If the average per capita income per family member is less than the regional subsistence level, then the family has the right to receive low-income status.
The income of each family member must be documented. This is a mandatory requirement. Therefore, families where some persons are unemployed or work unofficially do not have the right to obtain low-income status.
But if an able-bodied person does not have a job and applies for unemployed status, then the family will not be denied recognition as low-income. But women who have children under 3 years of age have every right not to work and not to be on the labor exchange, and this cannot serve as a basis for refusing to provide them with state support.
Let us give an example of calculations for recognizing the status of a low-income family. In one living space in Moscow live:
- A mother who is on maternity leave for a child under 3 years old.
- Employed dad.
- A 19-year-old child who is studying full-time at a university.
- Child 2 years old.
- Retired grandmother.
The family applied for low-income status in April, so its income for January-March will be taken into account. Mom has the right not to work, so her income does not need to be confirmed. The eldest child receives a scholarship in the amount of 1890 rubles. monthly, grandmother - pension in the amount of 8500 rubles. Father's income was: in January - 12,500 rubles, in February - 10,000 rubles, in March - 13,000 rubles.
Let's calculate the total income for the last three months: (12500+10000+13000+1890*3+8500*3) = 5670+25500+35500=66670 rubles. There are 5 people in the family. The average per capita income for the month was 13,334 rubles. (66670/5). This is less than the cost of living in Moscow, so the family has the right to count on receiving low-income status.

What documents are needed to recognize a low-income family in 2020?
Current legislation regulates the legal possibility of recognizing a family as low-income if its income level is less than the established subsistence level. In such cases, recognition of a family as low-income in 2020, that is, confirmation of this status occurs in the form of signing an agreement on the one hand by the social care authorities, and on the other by the low-income family.
To obtain low-income status for a family, it is necessary to submit an application to the social security authorities at the place of residence (registration) of the family. Payments that a low-income family can count on should be made to both complete and single-parent families.
And since each individual region of Russia sets its own required level of subsistence level, the amount of payments in these regions will be different. For example, Moscow has established a minimum subsistence level of 20,195 rubles (as of 2020).
Based on this, if each family member has an income less than the specified amount, then in this case such a family has the right to apply to the social care authorities.
The level of family income is determined based not only on the wages of its members, but also on the totality of all existing social benefits for the family. Confirmation of the level of income that allows a family to obtain low-income status is provided to the authorized bodies every three months. Such actions must be carried out due to the constant change in the level of the cost of living.
If a family receives low-income status, it can count on certain benefits and subsidies. Such opportunities include compensation for the difference between the standard of housing and communal services for each family member and actual utility costs.
The indicated compensation will be different in each region. Current regulations stipulate that the amount of utility bills that a low-income family must pay should not exceed 22% of the income level of such a family.
In the case where the amount of these payments is higher, a low-income family has the right to receive a subsidy.
Based on the regional size of the benefit that is paid to a low-income family for each member, then in Moscow, for example, it is 800 rubles. If the child’s age is from 1.5 to 3 years, then the amount of such benefit is 1,600 rubles. And if a child of the specified age is raised by one parent, then the amount of the benefit is 3,200 rubles per month.
Also, according to current legislation, a low-income family can receive a one-time annual benefit if it submits an application to social services located at the family’s place of residence.
In many regions of Russia, low-income families are entitled to certain other types of assistance.
For example, providing free meals for children at school, school uniforms, and free travel on public transport.
What is needed to obtain the status of a low-income family?
To obtain the status of a low-income family, it is necessary to submit a corresponding application to the authorized bodies. Such a statement may have a standard form, which is established in each individual region.
A sample of such an application can be obtained from the social care authorities. When submitting an application to exercise the right to obtain the status of a low-income family, photocopies of some documents and their originals are also provided.
To find out what documents are needed to recognize a low-income family, you need to familiarize yourself with the list of documents.
Such documents include:
- document confirming Russian citizenship and identity (passport);
- a document confirming the place of registration or place of residence (these documents are provided for each person from the family);
- birth document for children under 14 years of age;
- certificate of receipt of an identification number (not a mandatory document);
- documents, content information about family composition;
- title documents or documents confirming the right to reside in a dwelling (apartment or house);
- if the family moved into housing by court decision, then provide such a court decision;
- in the case of two or more families living in a house, an agreement must be provided, which is the legal basis and confirms the family’s right of residence in this territory (such documents may be an agreement for the use of premises, a social tenancy agreement, or other similar documents in their legal content;
- a certificate confirming the income of each family member for the previous 2 years.
- Such documents include:
-
-
- certificate form No. 2-NDFL. Such a certificate is provided upon request of an employee of the enterprise;
- The serviceman takes a certificate from his place of service;
- students or pensioners prepare a document containing information about the amount of a pension or scholarship from a pension fund or educational institution, respectively.
- if a citizen is unemployed, then a certificate of receipt of unemployment benefits must be provided from the employment service;
- a certificate or other document confirming the value of property that is subject to tax for each family member. Such property is real estate and vehicles (in this case, obtaining information about real estate, an extract from the unified register of ownership of real estate can serve as a confirming document);
- The property about which information must be submitted includes shares of participants in cooperatives (dacha garages, etc.). When providing a certificate of availability of a share, it also indicates its cost;
- a document on the estimated value of a real estate property, dacha, garage, etc.
- if there is a land plot, it is necessary to provide a document confirming the standard value of the land plot;
- if an independent expert assessment is provided, it must contain information about the value of all property owned by the applicant.
-
When deciding on recognizing a family as low-income and providing it with state social assistance, a calculation is made by dividing one third of the amount of income of all family members for the billing period by the number of family members.
The income of a citizen living alone when deciding whether to recognize him as low-income and to provide him with state social assistance is determined as one third of the amount of his income for the billing period.

-
-
- The family owns more than two residential premises or the shared ownership of the existing area exceeds 18 sq.m. for one person. As a result, if it becomes clear that the applicants live in a large house or multi-room apartment, assistance will be refused. Additionally, a privileged position is not inherent to those who have more than one garage or car space in a specialized local parking lot.
- When family members have 3 vehicles or 2 vehicles with a total operation of more than 3 years (used cars), the right to assign status is no longer valid.

Nuances of the procedure for awarding status
The application process involves writing an application supported by a package of documents. You can apply for the status of a low-income family at the Department of Labor and Social Protection of the City at the address: Moscow, st. Novaya Basmannaya, 10, building 1. In addition, you are allowed to visit “My Documents” branches where applications are accepted.
List of documents
The procedure requires the presentation of a package of documentation that allows you to verify the need to assign low-income status. The main document is the income certificate:
-
-
- According to form 3-NDFL for working citizens.
- Certificate from the educational institution when awarding a scholarship.
- For pensioners and disabled people, identification must be presented.
-
The reporting period is 6 months. You should add up the income for this period and calculate monthly income taking into account all family members. If the figure does not reach the average value of the consumer basket, there is no point in submitting documents.
When the parents are officially married but live separately, income statements for both are attached. Documents are needed to register a low-income family, since according to the law, income is considered for all persons. But if you are on state support, a certificate will not be required. For example, the rule applies to military personnel and prisoners.
The package of documents attached to the application includes:
-
-
- Extract from home book.
- Certificate of marriage or divorce.
- Certificate of family composition.
-
If you own cars or real estate, you must present the relevant documents.
Advice: If disagreements arise with the department or clarify the documentation package for recognition as low-income, you can use Government Decree No. 512 of August 20, 2003.
When a certificate is received stating that a low-income family is recognized as a preferential category based on verification of accepted documents, applications for support can be submitted. In the event of a difficult situation, it is possible to take advantage of a financial payment if the following requirements are met:
-
-
- Citizens are unemployed or receiving a pension, as well as if they have minor children.
- There is permanent registration in Moscow.
-
How to refuse a social package through State Services
Applicants can apply for a lump sum payment in the following cases:
-
-
- Fire, flooding in the only living space or theft.
- Death of a close relative.
- Paying for expensive medical services to save life (it is taken into account that institutions located in Moscow do not provide such assistance free of charge).
- Purchasing expensive medications prescribed by the attending physician.
- Purchasing household goods, food or other things due to an unfavorable situation for the family.
-
The receipt procedure involves collecting documents and writing an application at MFC branches. The list of papers includes:
-
-
- Passport and its copy.
- Certificates of cash receipts for 3 months for all family members.
- An extract from a personal account to pay for utilities or a house book (other similar papers can be accepted; data is often obtained through interdepartmental interaction).
- Certificates, prescriptions, medical papers and other documents indicating the occurrence of an unfavorable situation.
-
Important: After submitting your application, you should expect representatives of the social support service to assess the state of your living conditions. A decision on providing assistance is made within 30 days.
Low-income status allows you to qualify for a reduction in the amount of utility bills. The website of the City Center for Housing Subsidies provides an estimate of the maximum income for the allocation of money with the existing income of applicants. You can apply for compensation through the MFC or the state portal of the mayor of Moscow.
Low-income status provides many benefits and privileges. Upon proof of income and provision of several certificates, the family will be classified into a category. But it should be borne in mind that some conditions may prevent this.

How to obtain the status of a low-income family?
If you are not disabled, not a pensioner, or, say, not a mother of many children, the state will not pay attention to you and you will not receive social assistance.
The right to free “goodies” is usually tied to some kind of preferential status, for example, a labor veteran or a Chernobyl survivor. However, there is one loophole: the box with social benefits will open to you if you receive the status of a low-income family.
Here you get benefits, subsidies, and help in solving the housing problem.
In addition, everything is simpler than it seems: we count the income, collect documents and receive a certificate from the MFC. But only on condition that the income is really low. We tell you how to prove that you are a low-income family and how to formalize this status.
Who are the poor?
In the minds of the average person, the “poor” usually wear a shabby sweatshirt and beg for alms from the church. But the law defines them differently.
For him, this is a family or a citizen living alone whose average per capita income is below the regional subsistence level (clause 1, article 6 of Federal Law No. 134 “On the subsistence level in the Russian Federation”).
The cost of living varies across the country, so there is a difference between the poor and the poor.
For example, in Moscow the cost of living for able-bodied people is 2 square meters. 2019 was 20,195 rubles, in St. Petersburg - 12,584.3 rubles, and in the Belgorod region only 10,039 rubles. In other words, an adult single working man with a salary of, say, 18 thousand rubles. in Moscow will be considered low-income, but in St. Petersburg or Belgorod - not.
Please note that the cost of living for adults and children will be different. Usually the children's size is slightly lower. For example, in the Rostov region the minimum for able-bodied adults is 11,033 rubles, and for children – 10,752 rubles.
This is important for determining the family's subsistence level. Let's say, in a family of two adults and two children from the Rostov region, the conditional cost of living will be equal to (11033*2) + (10752*2)= 43610 rubles.
If the total income of these 4 people is less, they can formally obtain the status of a low-income family and receive assistance.
But bureaucracy was not invented to make everything so simple. Let's consider what conditions for obtaining the status of a low-income family are provided by the law in terms of calculating average per capita income.
How to calculate income?
The state calculates the income of the poor according to a special methodology defined by Federal Law No. 44 of 04/05/2003 “On the procedure for recording income and calculating the average per capita income of a family for recognizing them as low-income...”. It has a number of features:
-
-
- Firstly, income is considered for the three months preceding the application for the certificate.
- Secondly, all income is taken into account before taxes.

Difficulties during registration relate to collecting the necessary papers.
There is no single document that would guarantee automatic receipt of any subsidy. They are determined by specific organizations where parents apply. In addition, before you receive subsidies, you need to make sure that you are eligible for them. A certain region sets its own criteria that apply in that region.
The cost of living in each region is different; in Moscow it is 10,791 rubles.
According to the legislation of the Russian Federation, social protection employees are required to provide a written refusal to grant the status of a low-income family; this happens in the following cases:

About low-income families: how to prepare documents, what certificates need to be collected
Due to the crisis created in the country, many families found themselves below the poverty line. Financial payments and social benefits allow a low-income community to provide proper care to the older generation and raise children.
But before you turn to government agencies for help, you must first obtain the “poor” status.
What to do, where to send the petition, and who has the right to be called a low-income family, this will be discussed in the article.
What income must be for a family to be considered low-income?
A social unit can be recognized as low-income if the family’s financial income per person does not exceed the monetary minimum for living. It is necessary to calculate the total amount of all official earnings for the past three months, namely:
-
-
- wages;
- all accruals from bank deposits and deposits;
- funds received for renting out an apartment or other property;
- pension payments;
- scholarship;
- fee;
- child support;
- other benefits and benefits.
-
The resulting amount is divided by three and again divided by the number of all family members, including children. If the result is less than the financial minimum for living, which in Russia in 2018 is 10,701 rubles, the family has the right to be recognized as low-income. The cost of living needs to be clarified. It varies by region.

Important! In this case, a family is a group of persons permanently registered in the same territory and leading a joint household. The group includes children, parents, grandparents, guardians, and adopted children.
Calculation example:
-
-
- father brings financial income in the amount of 11,000 rubles;
- mother brings financial income in the amount of 7,000 rubles;
- grandmother receives pension payments in the amount of 5,000 rubles;
- my son receives a scholarship of 1,500 rubles.
-
Only four family members. Calculation (11000*3)+(7000*3)+(5000*3)+(1500*3) = 73500 – this is the income of the whole family for three months. Next, 73500/3=24500 is the family income for one month.
And finally, we divide the resulting amount among all family members 24500/4=6125. This is the amount per family member.
This amount, of course, is less than the subsistence minimum, so you can apply for registration as a low-income family.
