Payments to employed persons

The first payment that an officially employed mother of a second child can count on is a registration allowance. The procedure is carried out in a antenatal clinic. The following conditions must be met: the application must be submitted before the 12th week of pregnancy.

The benefit amount is 649 rubles. From January 1, 2020 – 680 rubles. You can receive the amount immediately after registration or later.

The application for payment is sent to the employer. Additionally, a certificate of incapacity for work issued by a medical institution is provided.

Maternity

Based on the Labor Code of the Russian Federation, a working mother has the right to pay for maternity leave. The latter refers to 2 periods - maternity leave (Maternity leave) and leave to care for a newborn up to 3 years.

Features of the purpose of payments:

  1. Allowance for BiR (Article 255 of the Labor Code). The leave includes 70 days before pregnancy and the same amount after. It is issued at the 30th week of pregnancy. Only women have the right to leave. The benefit amount is 100% of average earnings. The amount is available upon request in full.
  2. Monthly payment when taking care leave for a child up to 3 years old (Article 256 of the Labor Code). The amount of the benefit in this case will be 40% of the recipient’s average earnings. The family member who is actually looking after the baby also has the right to request a paid period. This could be a grandfather, grandmother, father.

Reference! Child care benefits are paid for up to 1.5 years. Previously, the amount was reduced to a purely symbolic value of 50 rubles. In this form, the benefit was paid until the child’s third birthday. But as of January 1, 2020, this type of benefit has been canceled.

According to Law No. 255-FZ, maternity benefits are provided from the employer, but in fact the funds are transferred from the FSS budget (Social Insurance Fund). Therefore, an application for payment should be submitted to the accounting department or the human resources department of the employer.

Clause 2 Art. 12 of Law No. 255-FZ establishes the application period - 6 months from the date of completion of leave under the BiR or from the day the child turns 1.5 years old. Funds are transferred to the recipient's card after 10-15 days from the moment the application is recorded.

If an employee goes from maternity leave to maternity leave, then in order to receive payments for the second child she will need to complete the first leave. It all depends on the timing of pregnancy.

Possible options:

  1. Exit from maternity leave for the first child to apply for leave under the BiR for the second child. If the first offspring is not yet 1.5 years old, then you will need to choose which benefit option to receive. At the same time, payment under the BiR for the second child and care allowance for the first are not provided.
  2. If the firstborn is more than one and a half years old, then the easiest way is to leave maternity leave and prepare an application for maternity leave.

In Art. 11.2 of Law No. 255-FZ explains that if a woman, without leaving maternity leave, acquires the right to receive benefits for caring for 2 children, then its amount is summed up. The payment assigned to the firstborn and the monthly compensation for the 2nd child are subject to addition.

Maternity leave for Chernobyl survivors

When living in the Chernobyl zone, the birth of a child is also the basis for paying maternity benefits. However, the amounts will be slightly higher than in other cases.

The following rules apply:

  • 157 rubles are added to the payment when registering in the early stages of pregnancy;
  • an additional 20 days are added to the standard vacation period for B&R (140 days);
  • In addition to payment for care leave, a monthly supplement of 3 thousand rubles is provided for a child under 1.5 years old and 6 thousand rubles for children from 1.5 to 3 years old.

The right to preferential payments arises only with long-term residence in a special zone. At least 1 year before the child is born in the resettlement zone. And at least 3 years in territories where the right to resettlement applies. Minimum 4 years – for zones with preferential economic status.

Benefits for students, individual entrepreneurs, military personnel

Compensation for maternity leave for individual entrepreneurs, lawyers, and notaries is provided in the standard manner, but provided that the recipient timely transferred insurance contributions to the Social Insurance Fund. In this case, the application is sent directly to the Social Insurance Fund.

The following are entitled to similar payments:

  • full-time students receiving education at universities, vocational schools, scientific organizations;
  • military personnel.

In the first case, an application for transfer of benefits is submitted to the dean's office of the educational institution. In the second - at the place of service.

Payments to non-working parents

It follows from Law No. 81-FZ that an unemployed woman who gives birth to a second child also has the right to receive benefits. However, this cannot be implemented in all cases.

According to Art. 6 payment under BiR is due to an unemployed mother if she lost her job for the following reasons:

  • complete liquidation of the organization;
  • termination by an individual of activities as an individual entrepreneur;
  • completion of the activities of a lawyer and a notary.

You can apply for benefits if your mother does not work, but becomes pregnant and registers with the employment center within 12 months after her dismissal.

If a woman is a housewife and is not looking for a job, then the B&R payment is not provided. The same as the benefit for registration before the 12th week of pregnancy.

At the same time, Art. 13 of Law No. 81-FZ opens up the possibility for a non-working mother to receive a monthly care payment. The basis for lack of work is dismissal due to the liquidation of the enterprise.

To receive payment, termination of the contract must take place within the period:

  • bearing a child;
  • holidays according to the BiR;
  • maternity leave.

In these cases, the calculation of benefits for caring for an infant up to 1.5 years old will be 40% of average earnings for the last 12 months of work.

If you are entitled to both caregiving benefits and unemployment benefits at the same time, you must choose one of the options. Using both amounts is not allowed.

Also, an unemployed mother has the right to submit a request for a monthly benefit if she was not subject to social insurance at all. In this case, the payment amount will be minimal - 6 thousand 554 rubles in 2020. To receive payments, you will need to contact the social security office at your place of residence.

One-time payment upon birth of a child

A one-time payment upon the birth of a second child is provided to both employed and unemployed mothers or fathers. For 2019, the amount is 17 thousand 479 rubles. From January 1, 2020, its size will increase to 18 thousand 100 rubles.

The employed recipient will need to submit an application to management. The request is supported by a birth certificate and a certificate from the second parent’s place of work stating that a similar payment was not transferred to him.

Unemployed applicants receive a payment from social security. In this case, the package of documents is supplemented with copies of the parents’ passports, the insurance policy of the recipient of the payment and his work record book.

Maternal capital

Since 2007, Russia has had a program for the payment of maternity capital at the birth of a second child. Support is provided to all families without exception if they have Russian citizenship.

Attention! The right to receive a certificate can only be used once. If maternity capital was not registered at the birth of the second child, then it is possible to submit a request later - upon the birth of the next children.

In 2019, the capital amounted to 453 thousand rubles. The amount was frozen back in 2015 and since that moment its value has not changed. However, indexation is planned to resume in 2020. From January 1, 2020, the amount of financial support will be 466 thousand 617 rubles.

The procedure for providing a certificate for family capital is enshrined in Law No. 256-FZ. The requirements for candidates are also recorded here. As well as the rules for using the amount. The main rule is the use of funds from the state only for those purposes specified in the law.

The main direction of capital realization is the improvement of housing conditions - the purchase of housing, the construction of a new house or its reconstruction. It is allowed to use the amount to pay the down payment on the loan.

In addition, if there is a mortgage, then the family capital is allowed to cover the principal debt or interest. But it will no longer be possible to repay a consumer loan using the certificate.

Also, funds from maternity capital can be used for:

  • payment for the child's education;
  • formation of the funded part of the pension (only for the mother);
  • purchase of goods and services required for the adaptation of a child with a disability (any member of the family).

A request for a certificate is sent to the Pension Fund of the Russian Federation. Permission to sell funds is also requested here.

Putin's monthly allowance

One of the recent changes was the possibility of receiving payments for a child up to 1.5 years old from family capital. Basis: Law No. 418-FZ.

The payment is assigned on an application basis only to low-income families. The level of per capita family income should not be higher than 1.5 times the subsistence level (LS). The value of the latter is established by the regional authorities.

Other conditions for the payment:

  • Russian citizenship for both the parents and the child;
  • birth of 2 children after January 1, 2018;
  • the payment amount is equal to the value of the minimum monthly wage per child recorded in the constituent entity of the Russian Federation (on average - 10 thousand 500 rubles);
  • the benefit is provided monthly until the child is 1.5 years old;
  • funds are transferred to the recipient’s card or account;
  • The right to payment will need to be confirmed annually.

In 2020, it is planned to adjust the conditions for providing the presidential (Putin) payment. The threshold of average per capita income for its registration will increase from January 1 to 2 subsistence levels in the region. The benefit will be paid until the child’s third birthday, and not until 1.5 years.

As for how to apply for a subsidy, you should contact the Pension Fund or the Multifunctional Center. The application is reviewed within 30 days. It is also possible to submit documents for a certificate and a monthly allowance at the same time.

For residents of Moscow

When children are born, Muscovites are entitled to so-called “Luzhkov payments.” Here we are talking about providing a one-time benefit to young parents.

Conditions for payment of funds:

  • parents' age – up to 30 years;
  • the amount of benefit for the birth of a second child is 7 subsistence minimums (PM in Moscow - 18 thousand 780 rubles).

Also, a young family can count on financial support at the birth of their first or third child, and each subsequent child. In the first case, the benefit amount will be 5 PM. In the second - 10 reps.

In case of multiple pregnancy, the right to payment is not lost. For the birth of triplets, the amount will be 5 LM for the first child, 7 LM for the second and 10 LM for the third. If twins are born, the calculation will be similar - 5 RM for the first and 7 RM for the second newborn.

If the family is already raising the first-born, then at the birth of twins the amount of the subsidy will be increased. For one child, a payment in the amount of 7 PM will be assigned, and for the second - 10 PM, because he will be considered the third offspring in the family.

How to process Luzhkov payments

An application for calculation and payment of benefits is sent to social protection. You can also send an application through State Services, but only if you have a personal account.

Documents are prepared in advance:

  • parents' passports;
  • certificate of the child for whom the payment is made;
  • birth certificates of other children;
  • a certificate certifying the fact that the second parent has not received a similar payment (requested from social security);
  • Marriage certificate;
  • child's registration document.

A request for a Luzhkov payment must be submitted within 12 months after the birth. At the same time, at the time of application, the age criterion is also taken into account. It is possible to submit a request when the applicant is already 30 years old, but no later.

Additional benefits

In addition to benefits for the second child, established at the national level, parents can count on regional payments. And here one should rely on the social status of the family.

Typically, additional support is provided to low-income citizens. And also for single mothers . The latter will definitely need to confirm their status by presenting a certificate of form No. 25 from the civil registry office.

In practice, assistance can be expressed in the provision of funds to purchase food and clothing for children. Or to purchase medicines.

What does a non-working mother have to do when she gives birth to a child?

Those who are not officially registered at work are entitled to:

  1. One-time payment at the birth of a child.
  2. Federal child care benefits for one parent.
  3. Putin's payments if you meet the conditions.

The order does not say anything about what needs to be done if you have lost your work permit or the employer has not given it to you. What if someone paid the tax for you, but you don’t know?

A sad example. A family with four children received regional child benefits. My husband worked unofficially. To confirm his income, his wife took an income certificate form from the social security agency. The individual entrepreneur for whom the husband worked part-time filled out this certificate.

After some time, the paid benefits were asked to be returned. Neither the tax office nor the pension fund had information about deductions for the income indicated in this certificate. Social Security recognized it as unreliable, and this is grounds for refusal.

In fact, officially the husband did not receive anything at all, but the court decided that the refusal to pay benefits was lawful.

A joyful example. The woman gave birth to a child and went to process Putin’s payments. She brought certificates of paid state benefits, as well as a 2-NDFL certificate for the last year.

The social protection department refused her because she did not have a certificate from her place of work. The woman went to court, and he explained to social security that she did not work, her employer had been liquidated, so she could not give a certificate. There is no special form of income certificate.

The submitted documents confirm the woman’s income. We need to give her an allowance.

If you receive more than 250 thousand rubles based on false information, the fraud will be considered major. For this they can be imprisoned for up to 6 years.
