What the law says. Is registration required for kindergarten?

Is registration of a child required by law? To find out whether permanent registration is needed to be placed on the waiting list for kindergarten, you need to refer to such regulations as Federal Law No. 273 and Order of the Ministry of Education and Science No. 293, which clearly regulates the process of assigning children to kindergartens, and also indicates a list of all necessary papers that the baby's parents must present.

As mentioned above, it is almost impossible to get a place in kindergarten without registration for residents of cities with a special status (Moscow and St. Petersburg), but for residents of other regions of Russia, registration is not a decisive factor when admitting a child to kindergarten, although in practice there may also be problems.

Federal Law 124 provides for certain categories of citizens who have the right to enroll children in kindergartens out of turn:

Is it possible to place a child in a preschool educational institution without permanent registration?

According to the law, the head of a kindergarten does not have the right to refuse to admit a child who does not have a local registration. If the institution has free places, they are required to accept children without registration.

For the second group, the number of places in preschool institutions is limited. According to the capital's education department, in 2016 no more than two thousand were allocated. In a city with a population of millions, this is extremely small.   2. Beneficiaries include those families whose parents study in Moscow, but have a permanent residence permit in another city.

  4. Adopted children (as well as those under guardianship) can also apply for a place in a preschool educational institution out of turn. Children whose parents have orphan status or have lost their breadwinner are equated to this category.

What the law says

There are several documents that determine the validity of residency registration requirements.

Firstly, this is the Federal Law of 2012 No. 273 “On Education in the Russian Federation” .

It follows from the order of the Ministry that preschool state institutions accept children living in the territory assigned to the kindergarten.

This means that the administration of preschool institutions has the right, first of all, to admit persons with permanent registration, second - temporary, and only then - those not residing in the given territory.

How to choose a child care facility
