Tightening the rules for withdrawing cash from non-registered cards

On March 18, 2019, the head of state signed Federal Law No. 33-FZ on amendments to Art. 7 and 7.1 115-FZ and in Art. 7 and 10 of the law on the national payment system.

The innovation will affect “anonymous” bank cards, from which it will now be more difficult to withdraw money.

According to the new rules, in order to carry out an operation to withdraw funds from such a card, you will need to undergo identification.

It is mandatory to provide your passport details, TIN, and SNILS.

At the same time, you can withdraw no more than 5,000 rubles per day, and there is a monthly limit of 40 thousand rubles.

Thus, now having an anonymous bank card, you won’t be able to withdraw money from it so easily; you will need to confirm your identity.

Control over withdrawal of funds from cards issued by foreign banks

The new rules will also affect cards issued by foreign banks. Starting from the end of June 2019, operations to withdraw funds from a bank card issued by a foreign bank will be subject to mandatory control.

Now the bank through which funds are withdrawn from such a card will be obliged to provide full information about the transaction to Rosfinmonitoring, and it, in turn, will carefully monitor such a transaction.

By June 2019, the Central Bank of the Russian Federation will prepare a detailed list of foreign banks whose cards will be controlled in Russia.

Restrictions may also affect cards issued by Russian banks. If there were previously signs of fraud on such a card, then additional restrictions may be imposed on cash withdrawals from it.

Right to receive cash in store

Not all innovations are aimed at tightening regulations; there are also those that, on the contrary, will make it easier for citizens to withdraw money. It will be possible to withdraw money from a bank card not only at ATMs.

From the second half of 2019 (the exact date has not yet been determined), the international payment systems Master Card and Visa, as well as Sberbank, announced a new program, thanks to which it will be possible to withdraw cash from the card in a store, if there is an appropriate terminal there.

To use such a service, you will need to make a purchase in such a store and pay for it with a bank card, in which case up to 5,000 rubles can be received in cash at the store’s cash desk.

Although the previously established limits for this type of card have not changed, now in order to withdraw cash from them, they must be tied to someone’s identity. In other words, in order to receive funds from the card, its holder must undergo a preliminary identification procedure.

This does not require signing new contracts, but you just need to provide the bank employee with your passport details. As a result, the owner will be added to a single database and will be able to withdraw cash from an unnamed card.

Rules for withdrawing cash from foreign cards

Plastic cards from foreign financial institutions also did not go unnoticed. If previously transactions on them were not subject to increased control, now they too are subject to accounting.

Now, about the procedures for receiving cash from such media, the bank servicing such operations is obliged to provide detailed information on them to the Federal Financial Monitoring Service no later than 3 business days.

The list of transmitted data includes:

  • Date, time, and place of the cash withdrawal operation;
  • Transaction amount;
  • Bank card number;
  • Information about the owner;
  • Name of the foreign bank.

If money is received not through an ATM, but through a bank employee, then additional information from the card holder will be required to identify the individual. This may be a passport or other identity document.

Despite constant tightening in the financial sector, not all cash withdrawal rules are negative. For the convenience of citizens, an additional option for cashing out funds has been provided. This can be done not only in bank self-service devices, but also at supermarket checkouts.

To use this method of receiving money, the cardholder must take into account a number of nuances:

  • The chain of stores must participate in the service program;
  • A specific retail outlet must have an appropriate terminal;
  • Only Visa and MasterCard payment systems are accepted for service;
  • The maximum amount available for withdrawal is 5 thousand rubles;
  • The service is available to store visitors only if they have made a purchase;

The process for getting cash at a supermarket is as follows

  1. The client pays for the goods selected in the store at the checkout using the card;
  2. Before making a payment, asks the cashier for the required amount of cash;
  3. The cardholder confirms the transaction by entering the PIN code;
  4. The bank that issued the plastic card approves the purchase and issuance of cash at the cash desk;

As we found out, this financial institution has introduced new rules for withdrawing cash from bank cards, which are currently already in effect in some regions, and from 2019 it should spread throughout Russia.

It's no secret that holders of bank cards from the financial institution Sberbank can withdraw cash from their accounts using ATMs or through cash desks in branches.

Although all these things can be found literally at every step, especially in large cities, in some places it is not economically feasible to maintain an ATM or even an entire branch, and therefore the credit institution decided to innovate the process of receiving physical material money.

It is reported that Sberbank allowed bank card holders to withdraw cash from accounts directly at terminals in various rural stores in test mode.

The State Duma Committee on the Financial Market recommended for adoption in the first reading a bill that would introduce restrictions on cash withdrawals from plastic cards of foreign banks.

If amendments to anti-money laundering law No. 115-FZ are adopted, all credit institutions will be required to inform Rosfinmonitoring of all such transactions carried out by both Russian citizens and foreigners.

Information about all facts of receiving cash from cards of foreign banks will be required to be collected by those banks from whose ATMs the withdrawal took place.

The message of the relevant State Duma Committee said that thanks to this innovation:

Rosfinmonitoring will receive additional opportunities to analyze financial flows in order to identify schemes for financing terrorist activities, extremist activities and, in general, solve problems aimed at ensuring the security of the Russian Federation.

Control over cash withdrawals will be significantly strengthened

Journalists found out that the list of countries whose bank cards will come under special control will be closed and will not be made available to citizens. Only the banks themselves will receive such information from Rosfinmonitoring and the Central Bank through interdepartmental communication channels and through personal accounts on the website of the supervisory service.

Total control over operations to withdraw cash from foreign bank cards, according to experts, will lead to an additional burden on banks.

After all, bankers will have to carry out the entire cycle of activities: from informing clients to the process of data collection, which is often very labor-intensive.

In addition, banks are already required to inform Rosfinmonitoring about all operations:

  • with cash in the amount of 600 thousand rubles;
  • with deposits in favor of third parties with cash deposits;
  • with payments for winnings in lotteries;
  • with real estate transactions in the amount of 3 million rubles.

Now this list will also include cash withdrawals from a foreign bank card, with no limit on the amount. At the same time, Deputy Director of Rosfinmonitoring Pavel Livadny argues that the amendments will not be relevant to clients of subsidiaries of foreign banks in Russia. As the official explained to reporters:

The bill has a strict anti-terrorism focus. Individual groups, as practice has shown, can take control of large territories with banking infrastructure and practically occupy the entire state. It is precisely such states that will be included in the list.

In addition, it is noted that cardholders themselves will not feel the restrictions until they are suspected of breaking the law. Only then can decisions be made regarding them to restrict the use of a bank card within the framework of Law 115-FZ. Moreover, the new norm will be the same for both Russians and foreign citizens.

Banks against

Bankers are unhappy with the innovation. They note that this will create many problems for credit institutions.

In particular, they expect increased customer unrest as "people often don't understand what a foreign bank is."

Therefore, explanatory work will once again fall on the shoulders of credit institutions, because citizens are seriously frightened by the huge number of different reasons and possibilities for blocking their accounts, cards and transactions.

Bankers also fear an increase in the cost of servicing transactions with foreign bank cards, due to the fact that they will have to determine the place where the transaction was performed, as well as whether it belongs to the list of countries in which Rosfinmonitoring is interested. In this regard, a commission for such operations may be raised.
