It is noteworthy that initially the legislation prescribed the mandatory involvement of professional teams in the construction of a house; accordingly, only families who used the services of contractors could use the certificate. But now this restriction has been lifted. The owner of the certificate was given the opportunity to independently choose where to send the funds.
In 2020, the amount of “Maternity capital” is 453 thousand rubles , these funds will probably not be enough to build a house from the foundation to the roof, but they may be enough to purchase building materials or, for example, pay for construction work and finishing finished premises .
The money can also be used to expand the area of an already constructed building (to make an attic out of an attic or turn a two-story building into a three-story one) - the reconstruction will be equated to the full construction of one’s own house.
Attention! If a family has already built a house on its own before receiving Maternity Capital, the family will be able to receive compensation for the construction.

House requirements
Article 10 of Law 256-FZ states that capital can be used for construction if the following requirements are met:
- The plot of land is owned and intended for individual housing construction;
- There is a building permit issued by the local government;
- Reconstruction must ensure an increase in the area of the house by at least one standard living area (from 14 square meters).
Do not forget about the conditions specified in the Urban Planning Code of Russia. Thus, in accordance with the provisions of the document, a residential building must be a detached low-rise building (no more than 3 floors) for one family to live in at different times of the year.
The object must be a capital building with load-bearing walls and a foundation, have engineering systems, including drainage, heating, ventilation, wiring, gas supply and others (if the structure is being built in populated areas without centralized communications, it is allowed to lack sewerage, water supply and gas supply).
Use of maternity capital up to 3 years
Russian legislation does not provide for the opportunity to use a certificate to build a house without waiting 3 years. However, you won’t have to wait until 36 months have passed from the date of registration of “Maternity Capital” with folded arms.
Construction on your own is a complex process, both from a legal and practical point of view. Today, the most responsible and protracted period is the period of collecting papers and documenting all work on the construction or reconstruction of a house. Only after receiving all this, the Pension Fund will consider the parents’ request to use the certificate.
Reference! The only exception to the general rule, which allows you to use Matkapital only 3 years after the birth of your second child, concerns credit funds.
You can cash the certificate immediately if one of the spouses has already taken out a loan (including a mortgage). You also won’t have to wait 3 years by taking out a mortgage after receiving Maternity Capital to build a house on your own.
In this case, the law allows the money to be used to pay the principal debt to the bank, interest on the loan or the down payment.
Where to start building a house?
Having decided to build a house for a family from scratch, you will have to deal with a number of issues, formulate an action plan, estimate expenses, plan all stages of construction and, of course, decide whether builders will be involved. It is recommended to take all this seriously and carefully, because, among other things, the owner of Maternity Capital will have to decide in advance how to use the capital.
The purpose indicated in the application cannot be changed in the future under any pretext. Those. Having indicated that the money will be used to pay for construction work, parents will not be able to use the funds to purchase building materials (and vice versa).
To build real estate, a family must have at its disposal a plot of land intended for individual residential construction. If Russians do not have land, the first thing they will have to do is acquire it or lease the land on terms of perpetual use.
Is it possible to build a house in a country house?
The answer is no, the lands of a dacha non-profit partnership are unsuitable (suitable only for the construction of a holiday home, outbuildings and cultivation of agricultural crops) and a garden non-profit partnership

Under what conditions can you build a house?
There are two ways to build a house using a mother's certificate. Involve contractors - all the work will be carried out without your participation, or build the house yourself. The second method will cost you much less - you won’t have to pay third parties for the work. But it will take your own time and effort.
About the land plot:
- The plot where the whole family will live must be located on Russian territory.
- The land cannot be used for building a house/dacha or for agricultural purposes.
- For this reason, if you are going to build a house with maternal capital, then you must already have land or you can purchase it with your own funds.
- The land plot must be located in a populated area.
- All communications, gas, water, electricity, sewerage must be connected to the site. You can build a house if the administration undertakes in writing and provides a project that includes a plan for connecting all communications by the time the house is completed. But practice shows that agreements are mostly not implemented by local administrations. As a result, families cannot move into a new home.
- The locality where it is planned to build a house for a family must have a school, kindergarten, clinic, hospital, and at least slightly developed infrastructure.
- The family buys the plot of land with their own money. Maternity capital is not allowed to be spent on purchasing land for construction.
How to register a plot of land as your property, read here.
About the house:
- According to the project, the house should be comfortable and functional for a family with children.
- The number of rooms is calculated taking into account the number of children and their gender.
- All amenities must be taken into account.
How do they give out money if the house is built on their own?
There are several nuances that you should be aware of:
- Maternity capital, in this case, is issued in two stages: the first time - at the beginning of construction (half the amount, no more), the second time - no earlier than six months later - the remaining amount.
- All expenses for construction materials, transportation and fuel for transport must be supported by supporting documents.

- You can build a house with your own funds, and then offset the costs through the certificate.

How to obtain maternity capital for building a house up to 3 years: 9 required documents
In 2010, changes were made to the program for providing maternity capital, allowing applicants not only to buy a finished house, but also to purchase building materials. It turned out that for some families it is more attractive to build a house themselves than to buy a ready-made one.
The only thing that stops applicants from using maternity capital in this way is the need to wait until the child is three years old. But under certain conditions, it is possible to use maternity capital to build a house without waiting three years.
How can you spend maternity capital to build a house?
First, let's figure out how you can use maternity capital to build a house.
Strictly speaking, the funds will be spent not only on construction, but also on the purchase of building materials. This is the only way to receive family capital in cash.
But this does not mean that the funds can be spent on anything. The pension fund will carefully monitor what the money was used for, and in case of violation, it will deprive the rest of the funds and demand compensation for everyone else.
Main options for using maternity capital for construction
Maternity capital can only be spent:
- for the purchase of construction and finishing materials;
- workers' compensation;
- payment for the work of equipment used for construction (including payment for gasoline, fuels and lubricants, etc.).
All expenses must be justified and supported by payment documents, i.e. checks, preferably sales receipts.
When should construction work be completed?
The law limits the timing of work. So, within 6 months the following work must be done:
- the foundation is poured;
- walls were erected;
- roof installed.
Finishing work is not limited in time, but must be completed within a reasonable time. Most often this means a period of 1 year.
The house must be intended for living - this must be reflected in the documentation. Dacha, garden house, garage, bathhouse, outbuildings, etc. It is impossible to build with family capital.
In addition, one more point should be taken into account. Land and a private house are two different real estate objects. A plot of land cannot be purchased using maternal capital funds.
This means that to begin construction, the family must either buy the land as their own or obtain an indefinite lease. The latter is even preferable, since it is much cheaper, and after building a house, the site can be privatized without any problems.
You can find out how to cash out maternity capital and what documents are required for this in this article.

How to get maternity capital to build a house for up to 3 years?
The procedure for obtaining a maternity capital certificate for building a house without waiting 3 years is standard.
Package of necessary documentation
First you need to submit the following documents to the Pension Fund:
- passport;
- children's birth certificates;
- birth certificate;
- SNILS.
Any parent can apply for maternity capital for the construction of a house without waiting 3 years; the requirement for only the mother to appear to receive the paper is illegal. In some cases, even issuing a certificate in the name of the father is more convenient if he is the one in charge of the construction.
Documents for building a house
The certificate will be ready within a month. In parallel with its registration, you will need to prepare other documents that will be needed to build a house:
- contract of sale or lease of land;
- building permit (issued in the architectural department of the administration);
- a project that involves the construction of a house with an area of at least 18 square meters for each family member - if there are 4 people in the family, then the area of the house must be at least 72 square meters;
- project estimate, which provides for calculating the cost of the house based on average market prices for building materials;
- agreement with the team that will carry out the construction.
In addition, you will need to open a current account at any bank with the ability to deposit and withdraw. It is important that this is not a deposit and that the bank does not charge a commission for the receipt and expenditure of money. The ideal option is a savings account at Sberbank.
You will also need to contact a notary and formalize an obligation to allocate a share to your children after the house is completed and put into operation.

Maternity capital for building a house without waiting 3 years: disposal and receipt of funds
After collecting all the documents, you can contact the Pension Fund with an order to spend maternity capital funds on building a house on your own for up to 3 years.
The organization’s specialists will check all documentation within a month. It is quite possible that the construction initiator will be called to clarify details or with a requirement to provide additional documents.
If everything goes well, then within the next month the Pension Fund will transfer the funds to the current account specified in the application. Now they can be used to pay for construction materials or workers.
Initially, the PF will transfer only 50% of the total subsidy. This amount should be enough to get started. After the applicant confirms the intended use of funds, the Foundation will transfer the remaining funds to the specified account. It is necessary to report expenses no later than 6 months from the date of allocation of the subsidy.
In addition, non-cash payments with a construction organization are possible if it undertakes the entire construction of the house. In this case, the funds are transferred not to the applicant’s current account, but to the account of the construction company.
Otherwise, the requirements for providing project documentation are the same; you will have to report on construction - that is, at a minimum, you will need to provide copies of certificates of ownership of parents and children to the Pension Fund.

Maternity capital for building a house on your own for up to 3 years: how to get around the three-year limit?
Currently, there is a limit of three years from the birth of a child, during which the family has no right to spend funds other than to pay off the mortgage. As of 2016, the restriction does not apply if a family wants to use the funds to pay a down payment.
Consequently, from January 2016, there are two opportunities to spend maternity capital funds on building a house without waiting for the child’s third birthday:
- build a house with your own funds using a construction organization, and then apply to the Pension Fund to receive compensation;
- build a house with loan funds, and then apply to the Pension Fund for early repayment of the housing loan;
- purchase an unfinished house with a mortgage at a reduced price and pay the down payment with maternity capital.
As a rule, building a house costs much more than the amount of maternity capital, so it’s still not possible to build a home with just a subsidy. Therefore, it is quite advisable to use one of the described methods.
Until what year is the Maternity Capital Program valid in Russia and how to become a participant - read here.
Bottom line
Thus, it is quite possible to spend maternity capital on building a house without waiting for the three-year moratorium to expire. In the usual case, you need to prepare all the project documentation, submit it to the Pension Fund and receive the funds in your hands. This will not be possible until the child is three years old.
Therefore, you must either buy an unfinished house using maternal capital, or build it at your own expense and receive compensation in the future, or take out a loan and cover construction costs with a subsidy.

Registration of land ownership can occur in the following ways:
- Buy a plot of land;
- Register the right of inheritance;
- Draw up a rental agreement.
Important to remember! State support funds are allocated only if housing conditions are improved.
Step 2. Choose a construction company
- If you plan to build houses yourself, then you can skip this step.
- But if you involve a construction company, then you need to be more responsible in your choice.
- When choosing a company you need to consider:
- Number of works completed (houses built, etc.);
- Time of existence in the construction market;
- Customer reviews.
It is important to know! Before concluding a contract with a construction company, you need to notify it that you will attract maternity capital during the calculation.
Not all private companies operate according to this mutual settlement scheme.

Before starting construction using the money from the mother’s certificate, you will have to prepare a certain package of documents.
The required documents include:

The completed package of documents is transferred to the Pension Fund, it is reviewed within 30 days . This time is allotted to the Pension Fund of the Russian Federation to make a positive or negative decision.
If the construction is approved, half of the amount will be transferred to the owner of the parent certificate. The rest of the money is paid no earlier than after 6 months. However, you will have to submit documents confirming the construction process during this six months.
Step 4. Receiving funds to the current account
The last step of this procedure is to receive money into your current account.
The procedure for transferring money depends on who it is being transferred to:
- if to the account of the owner of the maternal certificate, then the transfer is made in 2 stages: 1) after 2 months, part of the funds (no more than half of the total amount), 2) the remaining share no earlier than six months later;
- if to the contractor's account, the transfer is made in 1 payment.
Step 5. Construction of the house
If the construction will be carried out on its own, then the law sets a deadline for the owner of the maternal certificate: you need to have time to build the foundation of the house and its frame within 6 months (six months) . Since only after this the remaining part of the money will be transferred to the current account.

Maternity capital for building a house
The state supports families with children by paying maternity (family) capital. These targeted funds are used only in areas established by law. Improving the family's living conditions is one of these.
Is it possible to use maternity capital to build a house?
Living conditions can be improved by building a new residential building or completing an existing one. The owner can use maternity capital in construction in two ways:
- construction of an individual housing construction project (IHC);
- participation in a shared-equity construction agreement for an apartment building.
Today we will talk about the construction of a private residential building intended for one family. It will not be possible to build a house with maternity capital, the amount of which in 2020 is 466,617 rubles - it will not be enough. In addition to this, you will need personal savings or credit resources.
You can spend the subsidy when building a house for the following purposes:
- pay for construction materials and work;
- reimburse the costs of the finished construction;
- repay a loan issued for construction. Maternity capital cannot be used to pay for a plot of land for development or for renovation of residential premises.
Conditions for receiving funds in 2020
You can spend maternity capital on building a house if the following conditions are met:
- construction is planned on Russian territory;
- the right to a house arose after January 1, 2007 for cases when maternity capital is requested to complete the construction of an unfinished object, or to receive compensation for a previously built one.
- the developer sent a notice of the planned construction to the municipal authority for construction and architecture;
- design and estimate documentation for the house confirms that it meets the technical, sanitary and hygienic requirements for residential premises;
- The level of home improvement must correspond to the community infrastructure of the settlement. This means that when building a house in a town or village where there is no running water, sewerage or central heating, the house must be connected to the power supply and equipped with heating. In settlements with public utilities, the house must be landscaped and have technical conditions for connecting to the networks of resource-supplying organizations;
- upon completion of construction or reconstruction, ownership of the house is registered with the allocation of marital and children's property shares;
- the area of the house under construction must correspond to the accounting standard for living space per family member, approved by the local municipality;
- borrowed funds used during construction must be of a targeted nature. The loan agreement specifies their purpose;
- the developer has any legal right to the land plot for development: property; long-term lease, unlimited use; free use; lifelong inheritable possession. The land can belong to both the certificate holder and the spouse who is in a registered marriage.
The land plot has one of the following types of permitted use (PUR):
- individual housing construction;
- running a private farm.
List of documents
To receive money, an application for disposal of MK funds is submitted to the Pension Fund of Russia with the attachment of supporting documents, which can be divided into two groups:
- universal (subject to presentation under any circumstances);
- special (presented depending on the purpose of using the MK).
The universal ones include:
- applicant's passport;
- maternity capital certificate;
- right to a land plot: certificate of ownership, lease agreement, decision of the authorized body to transfer the plot on other grounds;
- notification of planned construction with evidence sent to the authorized body, if by the time the developer contacts the Pension Fund the developer has received approval from the authorized body, then it can be submitted;
- a notarized obligation of the certificate owner to allocate shares to children in real estate after completion of construction and registration of rights to it.
If the land plot belongs to the spouse, then additionally the following must be submitted:
- spouse's passport;
- marriage registration certificate.
The composition of other documents depends on the construction method chosen by the owner of the house.
Work can be carried out by contract, with the conclusion of a contract with a construction organization or on our own. In addition, the package of documents will differ depending on the developer’s additional sources of financing.

In the case of the contract method and ongoing construction, a contract and construction estimate are submitted.
If ongoing construction work is carried out in-house:
- upon receipt of a 50% advance, a universal package plus information about the bank account of the certificate holder is presented;
- after receiving the balance of the MK, an interim act for the main work (foundation, external walls, roofing).
When using MK funds to compensate for the costs of completed construction, the following must be submitted:
- construction contract and construction estimate, if a contractor was involved;
- primary expenditure documents for the purchase of building materials and services, if the work was carried out on our own;
- an extract from the unified state register of real estate on the registration of rights to a built house.
When using MK to repay a loan issued for construction:
- loan agreement with a repayment schedule upon payment of the down payment;
- when paying the principal and interest, additionally a bank certificate about the balance of the debt;
- an extract from the unified state register of real estate on the registration of rights to a built house.
How to get money without waiting three years
As a general rule, MK funds are paid upon reaching the age of three by the last child, with whose birth the right to maternity capital arose. there are exceptions to this rule . Before the three-year period expires, you can receive money:
- for compensation of expenses for completed construction;
- to repay a construction loan, including one issued before obtaining rights to the MK;
- repayment of a mortgage for the purchase of an unfinished property for completion.
Construction of a house under a contract
You can receive money for these purposes only three years after the birth of your second or next child.
The pension fund reviews the documents submitted by the developer within 1 month and transfers the money to the contractor’s account within 10 days from the date of the decision. The developer provides the contractor with the building site and permitting documentation.
But the contractor can handle its design himself. It is much easier for him to do this, since he is better familiar with the permitting procedure.
Contract agreement is a written agreement between the developer and the work contractor, containing all the essential terms of their interaction:
- the subject of the contract is a detailed description of the object being built. Can be issued as a link to the project;
- beginning and end of work;
- the duration of the contract, which, as a rule, does not coincide with the previous paragraph, since it presupposes some time for settlements and dispute resolution after completion of the work;
- information about which party provides the construction with materials, components, and fuel. The resolution of this issue depends on how the estimate is calculated. If the cost of construction according to the estimate includes material costs, then the contractor must provide the construction with materials. If the estimate only takes into account the cost of work and the use of equipment, then this is the responsibility of the developer;
- procedure for settlements under the contract. A one-time payment in advance is risky for the developer; payment after completion of the work is inconvenient for the contractor, since he does not have a source to finance current expenses. The best option is payment for each completed stage.
It is advisable to show the draft contract drawn up by the contractor to an independent lawyer or builder , if possible, and listen to their opinion.
For sections of the contract that raise doubts or questions, a statement of disagreements . Signed by both parties, it becomes an integral part of the contract and is binding.
When concluding a contract, it is stipulated that part of the payment will come from maternity capital .
Current legislation allows the indication of an approximate, inaccurate price in the estimate. This is due to the fact that in construction there are objective risks that the contractor cannot foresee, for example, the behavior of the soil during zero-cycle work: digging a pit and pouring a cushion under the foundation. The total amount due may exceed the original estimated cost.
The main difficulty with this method of using MK is the choice of contractor. If dishonesty or insufficient qualifications of the contractor leads to violation of work deadlines or failure to comply with construction requirements, then for the developer this may result in the recovery of budget money allocated for construction from him.
When choosing a contractor, you should pay attention to the following circumstances:
- Duration of activity indicates greater reliability and thoroughness of the contractor, experience and knowledge of local construction conditions.
- the presence of other facilities nearby that were previously constructed by the proposed contractor. It is advisable to visit them, inspect them and talk with their owners about the quality of construction and how the relationship with the contractor developed. A conscientious contractor is interested in providing such information to the intended customer.
- membership in a self-regulatory organization (SRO). When joining an SRO, a construction organization or entrepreneur is required to confirm the qualifications of its personnel: special education and work experience.
- information is also provided on the material and technical base : the availability of special equipment, transport, material reserves (a quarry for the extraction of sand, gravel and other building materials).
- In addition, when joining an SRO, builders pay membership fees, from which an insurance fund is formed to cover losses. The SRO acts as an arbiter of pre-trial settlement between the customer and the contractor. If the contractor’s actions are found to be unlawful, and it is impossible to recover the losses caused directly from him, then the recovery will be directed to the SRO insurance fund.
- information on the INTERNET. The contractor may have his own website, which contains information about completed projects, past customers and subcontractors. You can also refer to the website of the SRO, which includes the contractor.
- condition of the construction site. If there is chaos and disorder on the site, materials are dumped haphazardly, there is no proper fencing, workers wander aimlessly around the site or smoke continuously, the services of such a contractor should be refused.

Building a house on your own
This is one of the most convenient ways to cash out MK. The owner of the certificate receives money into his own bank account, from where he can withdraw it in cash without restrictions. But you should remember the accountable nature of these funds .
Do-it-yourself construction assumes that the developer independently organizes the construction process: obtaining permits, purchasing materials, attracting specialists and equipment. For each such action, documents are carefully drawn up : contracts, acceptance certificates, invoices, receipts. The papers are kept until submitted to the Pension Fund.
MK funds are transferred in two stages:
- When submitting an application for disposal of MK funds, 50% of the balance on the personal account is transferred to the bank account of the certificate owner.
- The balance of funds is transferred no earlier than 6 months after the developer confirms that the main work has been completed: installation of the foundation, construction of walls and roofing. This circumstance is confirmed by a special inspection report . You can get it from the authority dealing with architecture and urban planning. The procedure for issuing such a document is established by Decree of the Government of the Russian Federation dated August 18, 2011 No. 686.
