A response to the applicant's complaint from the Department of Education is given within 30 working days. The government of the Leningrad region has approved a list of documents required to receive a payment of 9.5 thousand rubles if the child was not provided with a place in kindergarten.
It will be possible to submit documents after January 1, 2020 at the MFC at your place of residence. There is no need to submit a document stating that a place in the kindergarten was not provided: social security institutions will independently receive it from the committee of general and vocational education through interdepartmental communication channels.
To receive the payment, parents must permanently reside in the Leningrad region together with the child and stand in line for a place in kindergarten for at least 1.5 years.
For the convenience of citizens, the period for applying for payment has been extended: if the applicant applies for it before the end of June 2020, it will be assigned from January 2020.
When assigning payments, the criterion of need approved by the Legislative Assembly of the Leningrad Region on December 3, 2019 will be taken into account - 70% of average per capita income (22,330 rubles in 2020).
If a citizen is already receiving social support measures taking into account the need criterion of 40% or 70% of average per capita monetary income, he may not provide documents confirming his income. In this case, a payment of 9.5 thousand.

Let's start with the fact that Article 43 of the Constitution of the Russian Federation guarantees universal access and free preschool education.
According to Article 5 of the Federal Law of December 29, 2012 No. 273-FZ “On Education in the Russian Federation,” legislation guarantees the right of every person to education, including the right of a child to receive preschool education, regardless of place of residence and registration. No circumstances can serve as a basis for refusal to receive preschool education.
But in practice things are different. And the situation is not so optimistic.
According to statistics, only 40% of children in our country (in some regions these figures are higher) at the age of three will be issued a ticket to kindergarten.
After the adoption of new legislation on preschool education, the situation became even worse. If previously, when a child reached 3 years of age, a parent could go to court with a demand to provide a place and win it, but now this is impossible! Why? Because an order has been put into effect according to which, on the basis of lack of places, admission to kindergarten is denied.
Thus, the new order of the Ministry of Education and Science of the Russian Federation dated April 8, 2014 No. 293 “On approval of the Procedure for admission to training in educational programs of preschool education” deprived more than a million families of the opportunity to get into kindergarten under three years of age. Judicial practice is not in favor of the applicants.
- Thus, the Supreme Court of the Russian Federation, when deciding the issue of the obligation to provide a place in a kindergarten, establishes the following circumstances:
- - the child reaches two months of age;
- — having the right to priority provision of a place in a preschool institution;
- — availability (absence) of places;
- — presence (absence) of persons entitled to priority provision of space;
- - if there are no places at the child’s place of residence, the fact that the parents (legal representatives) of the child apply to the executive body of a constituent entity of the Russian Federation, or a local government body, to resolve the issue of his placement in another educational organization.
- So, admission may be refused due to the lack of free places in the kindergarten.

In case of refusal to provide a place, everyone has the right to write a complaint against the official by contacting the education department that admits citizens. If the application is not considered, where else can you turn?
According to the law, parents can go to an appointment with the prosecutor's office or even send a letter to the President of Russia to resolve this issue in accordance with the law. The application will be considered within the period established by law and the only correct decision will be made.
Draft Federal Law No. 556611-5 “On Amendments to the Law of the Russian Federation “On Education” would make it possible to receive compensation for failure to provide a child with a place in state and municipal educational institutions in the amount of 5 thousand rubles. However, this document remained a draft.
At the same time, the decision to pay compensation for failure to provide a place in a kindergarten was made in some constituent entities of the Russian Federation. Such payments were appointed by the representative bodies of: Arkhangelsk, Krasnoyarsk Territory, Lipetsk, Perm, Samara, Smolensk Region, Tomsk, Khanty-Mansi Autonomous Okrug, Yamalo-Nenets Autonomous Okrug, Yaroslavl. Alas, the Krasnodar Territory and Sochi are not on this list.

- Article 256 of the Labor Code of the Russian Federation provides parental leave for up to three years, and only for this time the workplace and position are retained.
- The day after your child turns three years old, you are required to go to work, or, with the consent of the employer, take unpaid leave or regular leave.
If everything is clear with the next vacation, then problems may arise with vacation without pay. According to Art. 128 of the Labor Code of the Russian Federation, for family reasons and other valid reasons, an employee, upon his written application, may be granted leave without pay, the duration of which is determined by agreement between the employee and the employer.
Thus, providing unpaid leave is a right, not an obligation, of the employer. At the same time, the employee’s use of such leave is conditioned not only by submitting a corresponding application to the employer, but also by mandatory agreement with the employer on the possibility of providing such leave and its duration.
The Labor Code also provides for the possibility of leaving maternity leave for part-time work. According to Part 2 of Article 93 of the Labor Code of the Russian Federation, the employer is obliged to establish part-time working hours at the request of one of the parents (guardian, trustee) who has a child under the age of fourteen years (a disabled child under the age of eighteen).
Kindergarten without vaccinations!
Some parents are categorically against vaccinations. This may be due to fear of consequences from the introduction of vaccines, a special worldview and other factors. At the same time, they intend to send their child to kindergarten. It is then that a conflict may arise between the head and parents.
Children are admitted to state kindergartens on the basis of Article 43 of the Constitution of the Russian Federation, which states that the state provides every child with the opportunity to attend preschool institutions.

2013 No. 1014 “On approval of the Procedure for organizing and implementing educational activities in basic general education programs - educational programs of preschool education” it follows that admission to state preschool institutions is subject to a medical certificate. Therefore, it is enough for parents to bring a signed medical card along with the rest of the documents.
Previously, vaccinations were mandatory, and in their absence, the educational institution had the legal right to refuse to admit a child to kindergarten.
However, according to recent changes made to the legislative framework, this clause is no longer an obligation and therefore cannot serve as a reason for refusal.
At the same time, paragraph 1 of Art. 5 of the Federal Law of September 17, 1998 N 157-FZ “On Immunoprophylaxis of Infectious Diseases” provides for the possibility of refusing vaccinations, which must be confirmed in writing: the refusal is signed by a citizen, one of the parents or another legal representative, a medical professional and is contained in the patient’s medical documentation.
Thus, it is possible to register a child in an educational institution (kindergarten, school) in the absence of vaccinations.
At the same time, the lack of preventive vaccinations entails a temporary refusal to admit citizens to educational and health institutions in the event of the emergence or threat of mass infectious diseases (i.e., if there is no such threat, it is possible to register a child in an educational institution in the absence of vaccinations).
